Council Member Boyer asked the Council Auditors Office to explain the amendment.  She was particularly interested in knowing whether there were any clawback provisions.  Assistant Council Auditor Janice Billy explained the amendment and the clawback feature therein.  James Richardson, Neighborhoods and Housing Department, explained the bill and how the loaned funds would have to be repaid in the event that requirements were not met.

The Chair asked the Neighborhoods & Housing Department, the Office of General Counsel and the Council Auditor’s Office to provide the Committee with their perspectives of the substitute bill on the agenda regarding the foreclosure crisis.  The viewpoints largely focused on what was perceived as the intent of the legislation.  Wight Greger, Director, Housing & Neighborhoods, Steve Rohan, Deputy General Counsel, and Assistant Council Auditor offered their thoughts.  Director Greger felt that the intent of the legislation was to provide funding for foreclosure prevention.  In looking for a revenue source for that undertaking, vacant property registry was identified.  Since 2009, the State of Florida’s SHIP program had provided some funding; SHIP funding has subsequently been curtailed.  Steve Rohan explained OGC’s role in reviewing the legislation.   Assistant Council Auditor Janice Billy indicated that her office was satisfied with the substitute bill that all parities had arrived at.  A motion by Council Member Brown to move the bill, as substituted, failed for lack of a second; Council Member Daniels moved that the bill be deferred and by voice vote, the bill was deferred.  Council Member Brown suggested that the Committee tour the City to assess the foreclosure crisis and the efforts to address the issues.

A fairly lengthy discussion ensued.  Committee Members wanted to know how long it would be before we knew whether or not the U.S. Department of the Interior would be accepting the City’s donation of the Norman Studios.  Kelly Boree explained the DOI process; that feasibility study had just been completed, a first step.  The matter was now in the hands of the Congress to move the process further along.

There was a lengthy discussion on the Development Agreement.  Council Member Boyer observed that the developer would not be paying any ad valorem taxes because of the air strip factor.  Joe Whitaker, JEDC, replied that the developer would indeed be paying taxes on their equipment and plant.  The developer is leasing the land and hangar from the Jacksonville Aviation Authority.  As a government entity, similar to the Port Authority, JAA pays no ad valorem taxes.  Mr. Whitaker indicated that the Council always had the option of enacting fees  in lieu of” taxes; Council Member Brown indicated that he would like to meet with Deputy General Counsel Rohan to explore legislative options for the City to recoup its investment in possible fees. 

 

At the close of the meeting, the Chair, Council Member Gulliford, introduced a guest in the audience who came to Council Committee meetings to see and participate as a citizen, only to have his vehicle parked nearby ticketed.  The
Chair feels that citizens who came to City Hall to participate in or observe proceedings ought not be penalized with parking tickets.  The Chair asked Jessica Deal to bring this to the attention of the Administration in the hopes that a solution to the problem could be reached.
