BILL SUMMARY

 

The Committee reviewed draft legislation incorporating the Subcommittee recommendations.  Discussion included the membership of the Ethics Commission and the ability to self-initiate complaints and investigations.  It was stated that elected officials should be responsible for appointing members to the Ethics Commission, with appointments by the Council President, the Sheriff, and an additional appointment by the Mayor being initially proposed to replace provisions for appointments by the outside entities named in the draft.  This proposal was revised to provide for an appointment by the Public Defender rather than an additional appointment by the Mayor, and an amendment to the draft legislation making the changes was approved.  The Chair requested information from legal staff concerning the number of appointments proposed to the Council by the Mayor in the last four years which did not receive the Council’s confirmation approval.  In response to a question, Mrs. Carla Miller advised that the Ethics Commission currently has the ability to self-initiate complaints and investigations, but this would be eliminated under the proposed draft legislation.  An amendment to the draft legislation was approved to permit self-initiation of complaints and investigations by vote of six members of the Ethics Commission.  The draft legislation, as revised, was moved.
