There were a number of speakers and considerable discussion on this measure.  Browne Altman, a resident of the area, opposed the bill saying that closing the road was unnecessary for the proposed salt water mitigation bank.  Mark Hardesty, a resident of the area, opposed the bill; he was concerned that there was no assurance that the land would be used solely for a salt water mitigation bank; felt that there would be a restrictive covenant stipulating that in the event that if the mitigation bank was not permitted, the land would revert back to the City.  Nancy Altman opposed the bill.  Fran Beach opposed the bill, concerned about what would happen to the land if the salt water mitigation bank was not permitted.  Mike Saylor, representing the applicant, explained measures that the developer/applicant was prepared to do such as accepting language stipulating the sole use of the abandoned road would be for a salt water mitigation bank.  Resident Dan Moore spoke against the bill.  Carl Scalafrio, engineer for the project, indicated that he was available for questions.  Assistant General Counsel Kristina Nelson explained the nature of the amendment that was offered.  Saying that there were too many moving parts, the Chair indicated that he was deferring the bill.

Jessica Deal, representing Advanced Disposal, questioned the need for an additional landfill in the County, distributing a map and material indicating the location and nature of existing landfill operations in the County.  Resident Suzanne Hayes was disturbed that she had only received notification of the public hearing on Friday (the 17th).  The late notice of the public hearing, the lack of proper signage and concerns about water contamination were raised by resident Tabatha Carlyle.  Danielle Brantley, opposed the bill and noted that she received the public hearing notice on Saturday.  Terry and Carrie Brantley spoke against the bill, as did Jerry Deal and Vernon Simms.  Concerns were voiced about ground water, the hazards of heavy trucks with children awaiting school buses and the nature of the rural community.  Attorney Wyman Duggan felt that the public hearing notice was not in accord with Council procedure in the Ordinance Code.  Doug Miller, representing the engineering firm associated with Otis Road Landfill, LLC, addressed issues raised by the residents, explaining the measures that were taken in the design of the project that would mitigate and/or alleviate perceived problems.  Attorney Paul Harden addressed all of the issues raised, indicating that Otis Road Landfill, LLC, had met every requirement of the law; he noted the considerable distance between the landfill site and the nearest resident’s property; he noted that unlike  other landfills, the Otis Road Landfill site would he properly lined.  Mr. John Coxwell addressed the issue, indicating that he, too, had children and grandchildren living in the area and that he welcomed dialogue with the area residents and had taken steps to alleviate many of the problems that were raised as matters of concern.  The Chair decided to defer the measure.
