There was a lengthy discussion on this bill.

 

Council Member Holt, the bill’s sponsor, explained the legislation; Assistant General Counsel Jason Teal provided additional explanation, noting which properties would be affected by the legislation.  The intent of the legislation was to exempt properties from being cited for property maintenance infractions.

 

Council Members Crescimbeni, D. Brown and Bishop raised a number of questions and had concerns with the proposed legislation.

 

Council Member Holt welcomed suggestions or amendments that would make the Committee more comfortable with the bill; he was ready to defer the bill to craft a bill whose language could alleviate some of the concerns raised.

Prior to the vote on this and the proceeding, similar measure, Assistant General Counsel Dylan Reingold explained the process that the Committee was to follow:  having the 911 Committee staff explain how it arrived at its decisions; having Committee Members reveal any ex parte communications on the matter; hearing from the proponents of the appeal.  Mark Shelton, Planning & Development Department, and Chair of the 911 Committee introduced other 911 Committee members and staff present; in a PowerPoint, explained how the Committee arrived at its decision on addresses; a public hearing was opened and subsequently closed.

 

The Chair indicated that he was inclined to remand the measure back to the 911 Committee for further work because on the one hand, all the parties (petitioners for appeal) involved had followed the rules and had been in business for a number of years; on the other hand, the 911 Committee was mandated to come up with a consistent sequence of addresses.  In remanding the measure back to the 911 Committee, the Chair indicated that the Committee should come back with options that adversely affect the least  number of parties.  Council Member Hyde moved an amendment to remand the bill back to the 911 Committee.

Kyle Billy, Council Auditor’s Office, explained the bills and the Council Auditor’s concerns that are attached to the marked agenda.  The Chair wanted to know if the City Council is actually setting the base rates (18% as recommended by the Ruies Committee amendment).  Mr. Billy noted that the Ordinance Code mandates the Council to set the rates.  The Chair was inclined to defer the bills to address and resolve concerns that were raised.  Fred Forbes, for the Administration, argued against deferral; time was of the essence, failure to act right away resulted in the City losing money. Jessica Deal, representing Advanced Disposal, addressed the Committee, providing background on the negotiations and information that was not provided during the Rules Committee meeting.  Council Member Hyde moved to recommend approval of the bill without the Rules Committee amendment.
