OGC, the Amendment remands the appeal back to the Planning Commission with
the following instructions: (1) Review Zoning Exception application E-11-54
in a concurrent manner with the second Administrative Deviation request for
the same property, AD-12-03, which includes a request to decrease the
required parking from 33 spaces to 0 spaces; (2) Review Zoning Exception
application E-11-54, and the criteria set forth in the Ordinance Code for a
zoning exception, in light of the Riverside/Avondale Zoning Overlay and the
second Administrative Deviation request, AD-12-03; and (3) Provide express

OGC, the Amendment adds Guy Lachapelle as an owner and adds the following
conditions to the PUD zoning: (1) The Subject Property shall be developed in
accordance with the Development Services Division Memorandum dated March 22,
2012, or as otherwise approved by the Planning and Development Department;
(2) The following uses shall require site plan approval through a minor
modification in order to be permitted on the Subject Property: automobile
service stations, the rental of automobile vehicle, trailers and trucks and
auto laundries; (3) Establishments or facilities that include the retail sale
and service of all alcoholic beverages for on premises or off premises
consumption or both shall be prohibited; and (4) Semi-trailers drawn by a
truck tractor by means of a fifth-wheel arrangement and any motor vehicles
with an actual scale weight in pounds with complete catalog equipment of more
than 10,000 pounds, which are registered on the basis of gross vehicle weight
in accordance with F.S. § 320.08(4), and which are designed or used for the
carriage of goods or designed or equipped with a connecting device for the
purpose of drawing a trailer that is attached or coupled thereto by means of
such connecting device and includes any such motor vehicle to which has been
added a cabinet box, a platform, a rack, or other equipment for the purpose
of carrying goods other than the personal effects of the passengers shall not
be parked, rented or stored on the Subject Property. |
