to 72 feet to 30.30 feet for one home and 2) grants the waiver, subject to
the following conditions: (a) There shall be no further subdivision of the
Subject Property; (b) There shall be a site built home made with brick
construction; (c) The mobile home shall be removed within 2 years or prior to
the issuance of a building permit for the site built home, whichever occurs
first; (d) Access to the Subject Property shall be directly from Lenox Avenue
and not from the adjacent property; and (e) There shall be a driveway
constructed, built to City standards, prior to the issuance of a Certificate
of Occupancy for the site built home. |

2012, and adds the following conditions to the PUD: (1) The Subject Property shall be developed
in accordance with the Development Services Division Memorandum dated
November 7, 2011, or as otherwise approved by the Planning and Development
Department; and (2) Front entry garages for single family homes shall be set
back no less than 20 feet from the right-of-way, whereas side entry garages
for single family homes shall be set back no less than 15 feet from the
right-of-way. |

Development Department authority over Part 9 (Sidewalk cafes) of Chapter 250
and (2) modifies Section 656.401(ee) to clarify that regulations on outside
sale and service of alcoholic beverages do not apply to uses in the right-of-way
which are governed by Parts 8 and 9 of Chapter 250 of the Ordinance Code. |
