Bill Summary The committee engaged in considerable discussion with the
Council Auditor’s staff and with Curtis Hart and Shannon Eller representing
the Greater Jacksonville Agricultural Fair about the need for and the
parameters of the ordinance. There are
differing interpretations of terms of the contract and about past practice
regarding the fair, which has not always reflected the letter of the
contract. There was also discussion about a calendar of fair dates that has
apparently been used as the definitive calendar, but is not a part of the
official contract or exhibits to the contract between the City and the
association. The committee considered
numerous amendments to the bill to craft an agreement that fairly protects
both the City and the Fair Association and recognizes the important economic
impact of both the fair and the Florida/Georgia football game. AMEND/APPROVE
6-0 1. Require Fair
Association to submit copies of invoices documenting allowable expenses for
payment by the City. 2. Remove references to expenses or payments
in 2014. 3. Delete and references to paying advertising
expenses and add language clarifying that the City is not responsible for
utility expenses for fair contractors. 4. Delete references to Cecil Commerce Center
as a potential living site for fair contractors. 5. Add language committing the City to split
allowable costs with the Fair Association on a 50/50 basis up to a total of

purpose of the bill to refinance two loans on the project into a single loan
at a lower interest rate. The City’s
payback period would be extended from 2030 to 2047 and the City’s loan would
have to become subordinate to HUD’s loan.
Council Member Boyer asked about the pro forma projections of project
revenue and expressed the opinion that, as a business proposition, it was a
bad deal for the City unless it’s willing to put the $200,000 loan at risk
for the purpose of keeping the rental rates at the complex affordable with no

After the conclusion of the
regular agenda the committee heard a presentation from the Council Auditor’s
Office on the City’s Loblolly Wetlands Mitigation Bank on the Westside. The mitigation bank is a joint venture of the
City and a private mitigation bank on the adjacent land, the owner of which
operates the City’s mitigation bank as well under contract. The mitigation bank was created to provide
mitigation credits for Better Jacksonville Plan projects. The City pays the
private operator to jointly market and sell credits from the two banks, with
the City the operator splitting the revenue and the City paying a management
and marketing feel. The two banks have
been the only mitigation bank option in the watershed area, but another
mitigation bank has started in St. Johns County so now there is competition in
the marketplace and the City will have to reduce the price of its mitigation
credits accordingly to be competitive.
Marc El Hassan representing
another new mitigation bank planned for Clay County stated that the City’s
partner in the Westside mitigation bank – John Hale – is challenging his firm’s
attempt to obtain permits the Clay County side.
Mr. Hale disputed the allegation that he is attempting to stifle the new
company’s permits and explained his side of the story.
Council Member Boyer stated
that 2012-652 (amending the Capital Improvements Element of the 2030
Comprehensive Plan to reflect the latest CIP adoption) was referred to the LUZ
Committee but should also be referred to Finance. The CIE amendment doesn’t quite match up with
the CIP adopted plan and those two documents should be reconciled.
The chairman announced that
the Joint Rules/Finance/RCD Committee will meet on November 29th to
complete work on 2012-213.
