Peggy Sidman of the General Counsel’s Office explained the substitute.  The committee discussed at length the CIP amendment process, the threshold project value that triggers a CIP listing ($100,000), and various means by which funds could be transferred out of CIP project accounts by the Council or by the Public Works Director in ways that could circumvent the intent of this bill.  In response to a question from Council Member Schellenberg about the possibility of Council waiving the 2/3 vote requirement by a simple majority vote, Ms. Sidman indicated that the General Counsel’s Office is currently drafting a legal opinion on that point.

Mr. David Boeff of Towercom Inc. made a brief presentation about the evolution of the cell tower market in the last 10 years and the current market rate for towers and antenna space and answered questions from the committee.  The committee debated at length the merits of minimum tower lease rates vs. complete dependence on market rates.  The proper role of district council members in holding veto power over location of towers on public property in their districts was discussed.  Council Member Gulliford offered, then after discussion withdrew, an amendment to reduce the minimum lease rate from $25,000/year to $12,000/year with market rate negotiations from that baseline amount.

At the conclusion of the agenda Council Member Anderson reminded the members that the new courthouse will open this month.  Given the tasks remaining to be completed, particularly the administration’s ongoing negotiations with the judiciary about furnishing the hearing rooms on the 7th floor and with the State Attorney’s office about the design of their building, Mr. Anderson wondered if it might be prudent to delay the Council’s consideration of the pending economic development reorganization bills for a few weeks until courthouse matters are resolved and the administration can devote its full attention and resources to one major item at a time.  Jessica Deal stated that the Mayor’s office has separate teams working on both issues and definitely wants consideration of the economic development bills to continue.

 

In response to a question from Council Member Crescimbeni, Ms. Deal stated that the Council would have the Mayor’s tentative FY12-13 budget by the afternoon.

 

Peggy Sidman clarified that the committee did not want amendments to be drafted yet on bills that were amended by the committee but then deferred.
