	Bill Summary Fact Sheet Assistant General Counsel Carol Mirando explained the circumstances surrounding the settlement. Some of the tort issues with capped liability were settled in the City’s favor but the City was unsuccessful in getting a judge to dismiss the inverse condemnation charge, liability for which is not capped. In a trial situation the City faces a potential liability for damages and attorney costs of over $1 million. The OGC recommends settlement as the prudent course of action. The Ordinance Code has been amended since this case started in 2007 to establish a better set of procedures to avoid this sort of situation occurring in the future. AMEND/APPROVE 6-0 Add language & attach BT to appropriate fund balance to cover settlement
