November 7, 2012

Meeting Convened: 1:00 p.m.
Chairwoman Boyer convened the
meeting and asked Dylan Reingold to review the marked agenda which included 10
items to be deferred, 12 items ready for action and 3 public hearings to be
opened and continued.
2012-602 and -603 (land use
amendment and rezoning to PUD on San Pablo Parkway): Dylan Reingold stated that
the applicant will be decreasing the amount of property subject to these
ordinances by a small amount, so a revised legal description and acreage amount
will need to be included by amendment.
Ms. Boyer indicated that Council Member Clark had requested that these
items be taken up first on the agenda.
Steve Diebenow indicated that the homeowner association that he
represents has concern about the language of one of the conditions; he and Paul
Harden representing the developer will meet after the agenda
meeting to craft a solution.
2012-610 (large scale land
use map amendment on Garden Street): Mr. Reingold said that his research finds
that the City cannot issue building permits for development on the property
until after the amendment appeal deadline passes 30 days after the effective
date of the ordinance, therefore there does not appear to be any way to
expedite the issuance of a building permit to the property owner to begin work
immediately.
Chairwoman Boyer announced
that Council President Bishop will be in attendance this evening for purposes
of attaining a quorum, with several members excused.
Ms. Boyer asked the committee
members to check their calendars for availability to hold a special LUZ meeting
to hear the various Mellow Mushroom restaurant-related appeals. Potential dates are December 5, 6, 10 or 12.
