Dylan Reingold to reviewed
the marked agenda which included 4 items
to be deferred,8 items ready for action, 11 public hearings to be opened and
continued, and 5 items for second reading and re-referral.
2011-767 and -768 (appeals of
Planning Commission final orders re: Kickbacks Restaurant expansion plans): the
parties have agreed to a settlement. The
LUZ Committee will be asked to remand 767 (zoning exception appeal) back to the
Planning Commission to be considered in conjunction with a second
administrative deviation request that will be filed for 768. Karl Sanders representing the restaurant
stated that the parties are not at liberty to discuss the parameters of the
settlement agreement before the Planning Commission hearing, but it covers
items such as parking, lighting, security and landscaping and has been signed by both parties.
2012-14 (rezoning on Lane
Avenue from PUD to PUD): public hearing will be opened and continued. A
neighborhood meeting is scheduled for next week.
2012-62 (FLUM land use change
from MDR to HI on Old Middleburg Road N.): Mr. Reingold stated that the
applicant has requested a change in the land use from HI (heavy industrial) to
LI (light industrial), but the PUD rezoning in companion bill 2012-63 doesn’t
match the light industrial land use and the inconsistency will have to be
rectified at some point.
2012-82 (rezoning on 18th
Street W.): Council Member Lee requests deferral. The applicant’s
representative agreed to defer for one cycle.
2012-99 (development
agreement for warehouse project on Trout River Blvd.): Council Member Lee
requests deferral. The applicant’s representative agreed to defer for one more
cycle, noting that this will be the third deferral of this item.
2012-136 (rezoning on 103rd
Street): Mr. Reingold has a question about why the Planning Department proposes
to allow some conditions to be done by minor modification and others not.
2012-137 (sign waiver on San
Jose Boulevard): Mr. Reingold understands there may be an additional condition
to add.
2012-139 (waiver of road
frontage on Stratton Road): Mr. Reingold wants the Planning Department to
explain a potential confusion about whether the waiver applies to the whole lot
or to a portion of the lot; the map was unclear.
2012-140 (road frontage
waiver on Walgreen Road): Council Member Lee requests deferral.
