amount of JSO savings to be carried over to FY12-13 from $6.12 million to $10.5 million. The committee discussed the rationale for
the emergency request and debated whether the matter would be more
appropriately dealt with in the upcoming budget hearings. Sheriff Rutherford urged emergency action
so that he can begin making preparations for the orderly shutdown of several
programs and facilities and the lay-off of staff if that is Council’s

Council Member Crescimbeni gave an overview of effort to change
the method of appointment of one of the five members of the board from joint
selection by the other four board members to selection by the City
Council. In response to a question from
Council Member Lumb about whether the selection method for the board is
enshrined in the 30 year agreement between the City and the Police and Fire
Pension Fund, Deputy General Counsel Steve Rohan indicated that it was not. In response to a question about which would
prevail – the Charter or the 30 year agreement – if the issue was covered in
the agreement, Peggy Sidman indicated that the question would need to be properly
researched.
