Bill Summary

 

John Germany of the Office of General Counsel said that the office was in the process of requesting an opinion from the Florida Division of Retirement about changing the composition of the Police and Fire Pension Fund board so as not to jeopardize the continued receipt of $10 million per year in “chapter” funds from the state for the benefit of the fund.  He recommended adopting a substitute offered by President Joost that would appoint Adam Herbert and Walt Bussells to the board to replace the two members whose terms have expired, but does not amend the Ordinance Code to change the method of appointment of the 5th board member and does not appoint Randi Shoemaker-Culp to that position.  That could be done after a positive opinion is received from the state.  Several council members expressed their frustration with the apparently shifting opinions from the General Counsel’s Office about the legality of the proposed amendment and with the length of time it has taken to decide to request the opinion from the state.  The committee decided to move the original bill, not the Joost substitute, and to hold it in Council until the opinion is received.

Bill Summary

 

Council Member Jones explained his proposed substitute which would 1) exempt religious organizations and institutions from applicability of this bill; 2) delete references to “gender identity or expression”; and 3) add an exemption for small businesses (15 employees or less).  Michael Wedner of the General Counsel’s Office reviewed the substitute, noting the changes from the original bill, and answered questions about the enforcement mechanisms and the conciliation process.  The committee discussed at length the likelihood of conciliation producing a mutually agreeable outcome and the possibility of litigation arising from the adoption of this provision. Mr. Wedner and Mary Jarrett of the General Counsel’s Office discussed the applicability of current provisions of federal and state anti-discrimination laws.  The degree to which Jacksonville does or does not have a problem with discrimination in this area was discussed, as well as the number of other Florida jurisdictions that have a similar sexual orientation ordinance.  The applicability of a recent U.S. 11th Circuit Court case applying the federal protection against discrimination based on sex to a sexual orientation case was briefly discussed.

School Board member Becky Couch spoke in favor of the renaming.  In response to a question, Randy Wyse of the Fire and Rescue Department stated that the name change would not be problematic for emergency response personnel, who are continually training on road name changes, road closures, etc. in their service area.  The committee questioned T.R. Hainline, representing the developer who is widening and improving Duval Road, about the developer’s willingness to pay the costs of new street signs, FDOT signage and the expenses of residents and businesses on the road to change their addresses.
