Amendment

Deletes a provision allowing the Rules Committee to introduce a bill received after the legislation filing deadline; deletes a provision allowing a bill to be placed on the agenda for introduction prior to the Legislative Services Division having the full text of the bill.

 

 

 

13-349

Amendment

Per OGC, the Amendment provides for an amended DRI NOPC dated October 31, 2013 which among other things revises the roadway improvement requirements and sets forth an effective date subject to the provisions of Chapter 380, Florida Statutes so that the Development Order is contingent upon the effective date of a development order rendered by St. Johns County with terms that are in accordance with the terms of this Development Order, and in the event that a development order is not rendered by St. Johns County with terms that are in accordance with the terms of the Development Order on or before September 1, 2014, then the subject Development Order automatically becomes null and void, and of no further force or effect.

Amendment

Adds RLD-100-A and RLD-80 to list of authorized zoning districts; requires compliance with accessory structure setback requirements; provides for a 2-year pilot program with a maximum of 300 permits, a $25 permit fee, inspection by Code Enforcement following advance notice in response to complaints, and a review of the pilot program after 18 months by Code Enforcement with input from Animal Care and Protective Services.

Per OGC, the Amendment splits the land use designation request so that the approximately 30.69 acre subject property is designated with 18.18 acres of CGC and 12.51 acres of CSV.

Per OGC, the Amendment revises language such that the section shall not apply to the removal of trees on land classified as agricultural land pursuant to Section 193.461, Florida Statutes, if the removal of such trees is regulated through Best Management Practice criteria formally adopted into the Florida Administrative Code by the Florida Department of Agriculture and Consumer Services.

Per OGC, the Amendment revises the legal description so that the subject property being changed from LDR to CGC is 1.42 acres rather than 3.34.

Amendment

Per OGC, the Amendment revises the legal description so that the subject property being changed from RR-Acre to CCG-1 is 1.42 acres rather than 3.34.

Substitute

Per OGC, the Substitute changes the rezoning application from a request to go to the Industrial Light (LI) district on 3.96 acres, to a request to go to the Planned Unit Development PUD district on 332.59 acres, that generally permits light industrial and distribution facility uses, and adds a new entry road location and signage site, as more specifically set forth in the site plan and written description. The property is currently zoned PUD (Planned Unit Development) and RR-Acre (Rural Residential-Acre).

Per OGC, the Amendment adds the following conditions to the PUD: 1) The subject property shall be developed in accordance with the Development Services Division Memorandum dated October 10, 2013 or as otherwise approved by the Planning and Development Department.
