Substitute

Establishes new performance standards for the keeping of chickens in residential zoning classifications other than AGR and RR (where chickens are already permitted with existing performance standards), including standards for coop size and location, number of chickens, odor control, storage of feed, etc.; amends Ordinance Code Chapter 462 – Animals – to include chickens (excluding roosters) in the definition of “household pet”.

Per OGC, the Amendment splits the land use designation request so that the approximately 30.29 acre subject property (corrected from 30.69 acres) is designated with 17.43 acres of CGC and 12.86 acres of CSV.

Deletes preamble “whereas” clauses; shifts City regulatory authority from Neighborhoods Department to Office of Economic Development; adds definition of a “digital dispatch service”; amends the definition of “limousine” and “pre-arranged contractual carrier” to allow those vehicles to provide digital dispatch service; adds a minimum wheelbase requirement of 105 inches for Smart Way vehicles; provides that pre-arranged contractual carrier agreements may be either in written or electronic form by means of a computer, phone, or web-based electronic service that the place of pickup, destination, rate, estimated charge, name of the driver or vehicle for hire company and the license number of the vehicle providing the transport; provides for the creation by the City of an on-line public database of all active, permitted vehicle-for-hire drivers, medallion holders and vehicle descriptions, which shall be updated within 48 hours of a change in status of any driver, medallion holder or vehicle; adds a requirement for Digital Dispatch Services to collect and maintain permit, license and insurance information on all vehicles and drivers utilized by their service and to adhere to all applicable laws, statutes, regulations and ordinances relating to vehicles-for-hire, including local ordinances and regulations; adds a requirement that all Digital Dispatch Service vehicles must be inspected at least once every 120 days.

Per OGC, the Amendment incorporates a revised PUD written description, dated August 19, 2013; and adds the following conditions to the PUD: 1) The subject property shall be developed in accordance with the Development Services Division memorandum dated September 24, 2013 or as otherwise approved by the Planning and Development Department; 2) The permitted uses on the property shall be limited to single family dwellings and minor and major automotive repair; 3) The hours of operation for the minor and major automotive repair shall be limited to between 7:00 am and 7:00 pm; 4) Any free standing sign on the subject property shall be externally illuminated and limited to 12 feet in height and 50 feet in area on each side.

Per OGC, the Amendment incorporates a revised PUD written description, dated October 2, 2013; and adds the following conditions to the PUD: 1) The subject property shall be developed in accordance with the Development Services Division Memorandum dated September 18, 2013 or as otherwise approved by the Planning and Development Department; 2) The monument signs shall be non-illuminated; 3) The portion of the property adjacent to the public street shall be screened by a visual barrier not less than six (6) feet in height and not less than 95% opaque.

Per OGC, the Amendment incorporates a revised PUD written description, dated October 14, 2013 and a revised PUD site plan dated July 16, 2013; and adds the following conditions to the PUD: 1) The subject property shall be developed in accordance with the Development Services Division Memorandum dated September 19, 2013 or as otherwise approved by the Planning and Development Department; 2) All sag lenses, drop lenses and convex lenses shall be prohibited. Illumination levels at all property lines shall not exceed one-half (.5) foot candles (“f.c.”) when the building or parking areas are located adjacent to residential areas, and shall not exceed one (1.0) f.c. when abutting other non-residential properties. All lighting lamp sources within parking and pedestrian areas shall be metal halide, compact fluorescent or LED. The maximum light pole height in all parking areas should not exceed thirty feet (30’- 0”). An exterior lighting design plan, including a photometrics plan, pole and fixtures schedules shall be submitted at the time of Verification of Substantial Compliance for review and approval by the Planning and Development Department; 3) The developer shall mount light fixtures on canopies so that the lens cover is recessed or flush with the bottom surface (ceiling) of the canopy.

Substitute

Per OGC, the Substitute changes the rezoning application from a request to go to the Industrial Light (LI) district on 3.96 acres, to a request to go to the Planned Unit Development PUD district on 336.06 acres, that generally permits light industrial and distribution facility uses, and adds a new entry road location and signage site, as more specifically set forth in the site plan and written description. The property is currently zoned PUD (Planned Unit Development) and RR-Acre (Rural Residential-Acre).
