Substitute

Per OGC, the Substitute changes the rezoning application request from a Commercial Neighborhood (CN) district request, to a PUD district request that generally permits a commercial neighborhood development and an existing cell tower, as more specifically set forth in the site plan and written description. The property is currently zoned RR-Acre (Rural Residential-Acre).

Amendment

Corrects the lease rate reference from annual to monthly rate; attaches Revised Exhibit 1 – revised lease agreement dated 8.5.13; includes a more detailed list of improvements the landlord will make to the facility, including installation of a new HVAC system controlled by the tenant, capacity of the new elevator to be installed, re-roofing of the leased space, and compliance of all listed items on Exhibit E with the Americans With Disabilities Act.

Changes the first year lease rate from $39,999.96 to $55,000 and changes the second year lease rate from $260,199.96 to $275,500; attaches Revised Exhibit 1 – revised Imeson lease agreement dated 8.5.13; increases the landlord’s investment in tenant improvements from $650,000 to $800,000, to be amortized over the initial term of the lease; increases the landlord’s contribution to moving costs from $100,000 to $130,000.

Substitute

Clarifies that the prohibition is on direct gifts of travel to individuals, not to the City; creates a new Ordinance Code Section 111.405 - Travel Trust Fund; differentiates between donations of travel by prohibited vs. non-prohibited parties; ensures uniformity of definitions and terms on this subject in various relevant chapters of the Ordinance Code and conformity to the Florida Commission on Ethics rules and binding opinion.

Adds Parks & Recreation Dept. as oversight agency; attaches scope of service for the management plan as Exhibit 1; corrects appropriation for Maritime Management Plan from $100,000 to $200,000 and deletes allocation of $100,000 to Parks and Rec. Miscellaneous Grants; adds provision for reimbursement to Council reserve account of $100,000 upon receipt of FIND grant.

Includes two other provisions for the closure request: 1. The street name “Creekfront Rd” will be maintained as the street name.   2. The existing road sign will be maintained at the intersection of Southside Blvd. and Creekfront Rd.
