Amendment

Per OGC, the Amendment incorporates a summary of evidence, findings of fact and conclusions of law, grants the administrative deviation, and adds the following conditions to the approval of the administrative deviation: 1) A pedestrian gate shall be installed and maintained on the subject property, within 10 feet of the mutual property corner nearest the drop inlet along the northwest property line located adjacent to 4803 Ortega Boulevard. Said gate shall be 36 inches wide and constructed of aluminum pickets and shall remain continually operational and continually accessible from 4803 Ortega Boulevard. Such gate shall be installed within 30 days of the effective date of this ordinance; and 2) The maximum light intensity emitted by each light shall be limited to 900 lumens.

Per OGC, the Amendment revises the Notice of Proposed Change (NOPC) Description (Section D. Transportation Analysis, on page 8 of 28) so that 2 specified ITE Codes are eliminated, and 2 specified ITE Codes remain, for purposes of basing the conversion rate for the identified uses (assisted living facility and senior adult housing). Accordingly, the Amendment also reflects that the NOPC dated April 5, 2013 is amended as of June 18, 2013, with the “on file” document amended and replaced with a “revised on file” document.

Per OGC, the Amendment incorporates a revised PUD written description, dated April 25, 2013 and adds the following conditions to the PUD: 1) The subject property shall be developed in accordance with the Development Services Division Memorandum dated May 13, 2013, or as otherwise approved by the Planning and Development Department; and 2) The dumpster shall be enclosed with a six (6) foot high concrete block wall and gates.
