Amendment

Per OGC, the Amendment eliminates the ability to vary the angle of a single-family dwelling due to 1) compliance with the projection requirements set forth in section 656.432, or 2) through the use of landscaping, but creates a new exception from the angle requirements for single-family dwellings that are structurally integrated with an attached garage at the time of original construction or manufactured or modular home move on.

Amendment

Per OGC, the Amendment incorporates a revised PUD site plan, dated March 8, 2013 and a revised PUD site plan, dated March 8, 2013, and adds the following conditions to the PUD: (1)            The subject property shall be developed in accordance with the Development Services Division Memorandum dated February 15, 2013, or as otherwise approved by the Planning and Development Department; (2) There shall be a vehicular access point from the proposed development to Hammock Circle South, subject to the review of the Planning and Development Department; (3) Frontage along Hammock Circle South shall be treated as a rear yard for the purpose of setbacks; (4) There shall be no driveway access off Hammock Circle South for any individual lots; (5) The neighborhood identification sign on Girvin Road shall be limited to six (6) feet in height and twenty-four (24) square feet in area; (6) There shall be a maximum of forty-eight (48) lots; (7) Single family dwellings shall have a minimum of three bedrooms and two full bathrooms. Single family dwellings shall have a minimum of 1,800 square feet of heated and cooled living area or 2,200 square feet of gross floor area; (8)           The maximum height of any single family dwelling shall be thirty-five feet. No single family dwelling may exceed two stories in height; (9) The maximum lot coverage shall be 50%; (10) Any mitigation trees planted on the subject property shall be oak and a minimum of four inches in diameter; (11) The minimum front yard setback shall be twenty feet. The minimum rear yard setback shall be ten feet. The minimum side yard setback shall be five feet; (12) There shall be a wall a minimum of 6 feet high constructed along Girvin Road, constructed of either stucco or vinyl with columns or other materials approved by the Jacksonville Planning and Development Department.  A six foot high vinyl fence shall be installed and maintained along the north property line. A six foot high wood fence shall be installed and maintained along the south property line. The fences and wall shall be installed prior to the issuance of a certificate of occupancy for the first single family dwelling. Any mitigation tree planting shall be within ten feet of the southerly property line, subject to the review and approval of the Planning Department; (13) All homes must be at least 35% brick, stucco, stacked stone or other similar masonry product; (14) Section II(c)(2) of the written description shall be deleted.

Clarifies that approval of bill requires majority-plus-one vote of all council members, not a 2/3 vote; makes technical scrivener’s corrections.

Amendment

Makes section (e) effective 10/1/14; requires Animal Care & Protective Services to give first-time violators a30 day compliance period before issuing fines for violations related to tethering violations during a 6-month education period.

 

Floor amendment (Boyer): makes enforcement of all of the provisions affected by this ordinance subject to the education and warning period, not just subsection (b).

Amendment

Increases the appropriation amount from $14,255,000 to $14,315,088; increases the Banking Fund borrowing authorization from $15,415,000 to $15,475,000; adds the Finance Department as an oversight agency; directs teh Finance Department to structure the borrowing in such manner as to annually utilize the entire amount of funds that would have been spent on rent of the building for amortization of the loan and to the extent possible, that purchase of the building be made from long term rather than short term borrowing; replaces Exhibit 1 with Revised Exhibit 1.

Attaches revised BT as Revised Exhibit 1 to reflect year 1 of 3 funding; deletes CIP amendment references in bill and removes CIP Schedule; changes the appropriation amount from $1,419,781.48 to $473,260.33 to reflect first year of three year grant.

Amendment

Per OGC, the Amendment attaches Exhibit 3, a picture of a box-truck, and adds the following conditions to the PUD: (1) Development within the PUD shall comply with Section 656.341(g) of the Zoning Code; (2) No food shall be prepared for on-premises consumption by the public; (3) One box truck substantially similar to the photograph in Exhibit 3, attached hereto, shall be allowed to be parked and/or stored on site; (4) All lighting shall reflect away from any other residential structures; (5) The exterior of the building shall retain the residential character.   And no alterations shall be made thereto without the approval of the Planning and Development Department; (6) Delivery of food supplies for preparation shall only take place during normal business hours – 7 am to 6 pm, Monday through Sunday; (7) The building shall only be painted in earth tones subject to the review and approval of the Planning and Development Department.
