At the beginning of the meeting Council
President Bill Gulliford welcomed the committee and stated his willingness to
be of assistance to the committee in any way necessary. He intends to attend most if not all of the
budget hearings, and also suggested that the Finance Committee appoint
subcommittees to undertake special studies as needed.
Peggy Sidman of the General Counsel’s
Office distributed and briefly reviewed two OGC memoranda relating to the
Mayor’s veto power over budget-related ordinances. The mayor has the power to veto particular
line items within the budget ordinance, but not the entire budget. The mayor does not have veto power over
millage levy ordinances. Council Member
Clark noted that the 3% property tax annual increase cap enacted by the voters
in the 1990s was subsequently ruled unenforceable by a General Counsel’s legal
opinion, so the cap now has advisory status only.
Council Auditor Kirk Sherman reported
that the “rolled back” millage rate and tentative millage rate for tax year
2013 must be transmitted to the Property Appraiser by August 4th (35
days after the certification of the preliminary tax roll) for advertisement on
the TRIM notice as required by state law.
That tentative rate is the maximum that can thereafter be levied by the
Council without another time consuming and expensive advertising and
notification process. The rolled back
rate this year is actually a rolled up rate - declining property values mean
that the millage rate would have to be increased slightly over last year’s rate
to produce the same dollar value of property tax revenues. Mr. Sherman also
noted that the proposed millage rates for the Beaches cities and Baldwin are
governed by the Interlocal Agreements between Jacksonville and those
jurisdictions.
Council Member Crescimbeni requested
the General Counsel’s Office to draft an Ordinance Code amendment to require
that the tentative millage rate ordinance be filed by June 1st each
year using the current year’s millage rate as the default rate so that Council
is not placed in the position of having to pass the tentative millage rate
ordinance as a first reading emergency at the only Council meeting in July each
year.

Economic Development and Derek Igou of the Clerk of the Courts’ office about
why a resolution to the juror parking issue has not been reached after months
of negotiation. Mr. Igou indicated
that the Clerk and the City fundamentally disagree over where jurors should
be parked and at whose expense and have not been able to come to a mutually
acceptable solution. The fact that one
of the two garages under consideration is managed by a private company and
subsidized by the City complicates matters in that there are financial and
economic development incentives not to displace private sector paying parkers
with publicly paid juror parking.
Council President Gulliford asked Mr. Crawford to investigate and
report on allegations that the current juror shuttle contractor was not paid
by the City for many months before receiving a payment within the last week. |
