Bill Summary AMEND/APPROVE
4-0 (Multiple Amendments) Amendments included the deletion of the octave band
requirements; provision for a broadband decibel level of 105 during a
permanent event; limiting the costs for EQD monitoring staff to no more than
$1,000.00 per day; deleting the reference to the City’s capacity to “pull the
plug” and replacing it with a 3-year suspension for the 6th
violation of the sound level provision; modified the notice of violation
procedure to require that the promoter has a compliance contact at the soundboard
to receive any notice of violations. Committee Members wanted promoters of future concert
events to know that they had assurances that there would be waivers in place. At the meeting’s outset, the Chair indicated that she had
the discretion to defer the measure, but was prepared to move forward if all
concerns were addressed and questions answered. The Committee Members asked Steve Pace to explain the
equipment used to measure noise levels.
It was decided that in selecting a mechanism to establish a noise
level, the City would not be required to provide the equipment. Stating that he was looking for fairness, Mr. Mike Yocane explained his positions on the numerous issues raised
in the discussion. He cautioned that
it was not possible to always control sound engineers at concerts. At the suggestion of the Committee Chair, Council Member
Dr. Johnny Gaffney indicated that he would be calling a noticed meeting in an
effort to enable all interested parties to resolve issues and “pull
loose-ends together.” Repeatedly, the Committee Members reiterated the need to
vote this item out of Committee so as not to discourage future concert deals. |
