George Gabel, the attorney who represented the Florida Times-Union in the recent Denton v. City of Jacksonville litigation involving alleged violations of Florida’s “Government in the Sunshine” law, but who appeared in the capacity of a private citizen, distributed several documents and addressed the committee regarding the various pension- and collective bargaining-related lawsuits and administrative challenges still pending in various venues. He believes that the actions, if pursued, will eventually end up in the First District Court of Appeals which recently ruled in the Denton case in a manner that he contends found the so-called “30-year agreement” between the City and the Police and Fire Pension Fund to be a collective bargaining agreement. He urged the Council to abandon that agreement and to negotiate the outstanding issues without reference to that document. In response to a question from Council Member Crescimbeni as to whether it would be more effective for the City to repeal the “30-year agreement” unilaterally or to seek a declaratory judgment against the validity of the agreement from a judge, Mr. Gabel advised repealing the agreement, thereby putting the Police and Fire Pension Fund in the position of having to defend the validity of what he believes the courts have ruled to be an illegal agreement.

 

General Counsel Jason Gabriel strongly objected to the committee giving Mr. Gabel, a litigant against the City, a forum to espouse his interpretations of court rulings and to advise the Council on legal strategies.

 

Council Member Crescimbeni stated that the information e-mailed to the council members late the previous evening from the Finance Department did not fully address the questions he posed in the Council’s recent Committee of the Whole meeting and in the last Finance Committee meeting. He requested City Treasurer Joey Greive and Robert Dezube, the City’s actuary with the  Milliman firm, to provide him with detailed information about the additional salary costs that are assumed in the actuarial model that produced the estimate of over $1.4 billion in savings over 30 or 35 years; that extra salary cost is a material consideration in determining the cost/benefit of the strategy of paying down the unfunded liability with extra payments in the first 10 years. Chairman Clark urged that all future analyses produced by the administration reflect a 30-year analysis equivalent to the earlier pension reform proposals, not 35 years as proposed in the latest revision. Council Member Schellenberg said that guaranteed positive cost of living adjustments are fiscally unsustainable and have been abandoned by most employers.

 

Council Member Boyer said that she has not gotten the results of various actuarial calculations that she requested of the administration in June and asked Council Auditor Kirk Sherman if there are any other avenues for having those calculations done in a time frame that would provide the results before the Council’s only meeting in December. Mr. Sherman indicated that his staff does not have the expertise to make actuarial calculations and that hiring another actuarial firm would probably not produce results by the December meeting because the new actuary would have a steep learning curve to understand the City’s actuarial assumptions, models and calculations. Ms. Boyer believes that the Council should consider alternative means of obtaining expert opinions on complicated matters if the information provided by consultants hired by the administration can’t be produced in a timely manner or does not reflect information on policy options specifically requested by the Council.

 

Council Member Schellenberg requested Deputy General Counsel Peggy Sidman to distribute to the committee members the latest updated list of all proposed amendments to the bill.

John Pappas stated that building a new structure to serve the needed purpose would cost approximately $5.5 to $6.5 million. The current facility, a former vehicle inspection station on Wilson Boulevard, is in very bad condition, would be expensive to renovate and would not be large enough to serve the purpose even if renovated. Council Member Gulliford advocated for a lease/purchase option since the City will need a long-term storage facility for the vehicles. Council Member Brown urged the administration to demolish the Wilson Boulevard facility if it is no longer in use rather than leave a blighted building on the site. The estimated cost of demolition is $15,000.
