Summary Fact Sheet R: Sub/Rerefer 6-0 Assistant General Counsel Paige
Johnston distributed a list of 12 amendments proposed by various council
members. The committee engaged in lengthy discussion with Robert Dezube with
the Milliman company, the City’s actuary, City Treasurer Joey Greive and
Mayor’s Chief of Staff Chris Hand about the assumptions included in the
calculations of the potential savings that would be produced by adoption of
the current pension reform proposal. Committee members requested a
recalculation of the potential savings using several different assumptions
relating to growth in covered payroll, the timing of the restoration of the
2% pay reduction currently in effect for covered employees, the assumed rate
of return on pension fund investments, the length of the agreement (30 versus
35 years), and others. The committee also engaged in
considerable discussion with Chief Deputy General Counsel Derrel Chatmon over
the status of the various litigation and appeals related to the collective
bargaining process and the 30-year agreement between the City and the Police
and Fire Pension Fund. Mr. Chatmon clarified remarks he made yesterday to the
Rules Committee and stated that the City is currently in a state of impasse
with the police and firefighter unions. The parties are awaiting a ruling
from the Florida Public Employee Relations Commission on an unfair labor
practices charge filed with PERC by the FOP. George Gabel, a Holland
and Knight attorney who represented Florida
Times-Union editor Frank Denton in a suit against the City alleging violation
of the state’s Government in the Sunshine law by negotiating changes to
pension benefits with the PFPF board in the context of court ordered private mediation,
addressed the committee identifying himself solely as a private citizen. He
said that the trial court judge and the appellate court both ruled that the
discussions constituted collective bargaining and therefore should have been
done in the sunshine. He believes the City should use the courts’ rulings as
a vehicle to declare the 30-year agreement invalid and to take the offensive
in negotiating pension changes directly with the police and fire unions.
Derrell Chatmon cautioned the committee that the courts had ruled solely on
the Sunshine Law allegations and their findings did not deal with the
validity of the 30-year agreement, which has many facets and ramifications
beyond specific pension benefit levels, including management issues of the
PFPF and the use of Chapter 175/185 funds. In response to a question from
Council Member Crescimbeni, Assistant General Counsel Steve Durden said that
the City Council could choose to breach the 30-year agreement but could not
simply vote to repeal it because it is a contract agreed to by two parties
and may not be unilaterally terminated by one side. Mr. Durden also responded
to questions from Council Member Holt about whether the City Council or
individual council members could meet with one or more members of the PFPF
board to discuss possible amendments to the pension proposal without that
constituting collective bargaining. Mr. Durden explained that the situation
is very complicated because of the differing roles of the executive and
legislative branches in the collective bargaining process. SUB(R)/REREFER
