At the
conclusion of the agenda Council Member Boyer gave an overview of the CIP
Committee’s work to date. The committee has reviewed accounts that are in cash
deficit and work is on-going to determine subfund balances in many accounts. A
review of the Better Jacksonville Plan project list shows that the City fully
borrowed the $1.5 billion authorized with the backing of the local option sales
tax, which did not produce additional revenue for the pay-as-you-go portion of
the plan that was anticipated and probably will not during the next 12 years. Figures
from the Finance Department and Council Auditor’s Office indicate that the City
has expended $16 million on BJP projects over and above what was borrowed by
using pooled cash from other project authorizations, and still has
approximately $15 million in additional BJP contractual obligations to fund.
Another source of revenue will need to be found to make up the difference,
possibly Banking Fund borrowing.
The
committee has voted to recommend close-out of all BJP projects without further
“dangling obligations”. Another list has been compiled of projects planned but
never begun, which will be recommended for transfer to the CIP program for
comparison and ranking versus other already-listed CIP projects. Council
Members Gulliford, Crescimbeni, Anderson and Schellenberg (Chairman) have been
appointed to a subcommittee to make recommendations on City policies regarding
the CIP and debt.
The
committee will move to a discussion of the stormwater utility’s projects at its
meeting this week, then will move to a discussion of previous bond issue
project lists (Autumn bonds, 1997 bonds) that are also in cash deficit despite
projects not being completed. Ms. Boyer said that she has met with General
Counsel Jason Gabriel, attorney Gayle Petri, and Joey Greive and Marc Stickney
of the City Treasury Division to discuss legal obligations of how bond funds
must be spent and what the City’s obligations are to construct the projects
that were listed in the bond documents. There appears to be neither
authorization of nor a prohibition again shifting bond proceeds from one
project to another as cash needs arise. Council Member Crescimbeni said that
this is a hugely complex problem that has been developing over the course of at
least 2 or 3 mayoral administrations and it will be difficult to sort out and
pin down. Chairman Clark suggested that
the City may need to go back to its former practice of collecting potential
projects over time and bundling them into stand-alone bond issues with single
revenue pledges to re-instill borrowing discipline, recognizing that the
transition from the current method may be a painful process. He believes the
creation of the Banking Fund has made borrowing too easy and attractive and has
undermined borrowing discipline. Council Member Gulliford suggested that former
mayors pandered to the voters by rolling back the property tax millage year after
year while increasing the City’s borrowing to fund necessary projects.
Chairman
Clark appointed an Audit Subcommittee for FY14-15 comprised of Council Members
Schellenberg (Chair), Carter and Crescimbeni. The committee’s first task will
be to help in the selection of the City’s independent auditor via an RFP
process.
