At the beginning of the meeting Council Member Schellenberg noted that the City Council had reduced the Fire and Rescue Department’s budget by $175,000 during the recent budget adoption, an amount representing the approximate value of the salary and benefits for a position that the Council wanted defunded. He understands that the previous incumbent is still in that position and that the department is covering the salary and benefit costs by leaving other departmental positions vacant. Steve Woodard, Emergency Preparedness Director for the department, described the grant from the Rockefeller Foundation that this position is meant to administer and the City’s matching funds requirement. Council Member Crescimbeni requested copies of all correspondence between the JFRD and the Rockefeller Foundation regarding the position in question (Chief Resiliency Officer), its salary, and the City’s financial commitments to the grant.

Assistant Council Auditor Kyle Billy reviewed the 13 amendments approved yesterday by the Rules Committee. The committee discussed the qualifications for the IG position and the relative importance of investigatory and auditing experience versus process efficiency and productivity improvement experience. The committee engaged in extensive discussion of the role of the IG with regard to the City’s constitutional officers and independent authorities. Assistant General Counsel Steve Durden gave a brief overview of his legal research into the separation of powers issues involved in where the IG’s office is located organizationally and to whom it reports. The committee discussed a possible City Charter amendment referendum by which the voters could choose to make the constitutional officers and independent authorities clearly subject to the full jurisdiction of the IG.

 

AMEND/APPROVE 5-4 (Clark, Brown, Carter, Daniels opposed)

 

1.     Appropriate $206,319 from OGC retained earnings

2.     Have constitutional officers and independent agencies opt in to IG jurisdiction rather than require it

3.     Increase employee cap by 4

4.     Add “prevent” and strike “identify”

5.     Master’s Degree is preferred

6.     Require IG Certification within 24 months of hire date

7.     Change periodic reports to an annual report.

8.     Change hiring requirements to prohibit the IG from having been employed by the City within the past 2 years (except within the IG’s Office)

9.     IG and Council Auditor shall obtain respective approval prior to an offer of employment of their respective employees

10.   Add a severability section

11.   Add $500 penalty for violation of this code provision

12.   State that the Part does not apply to the State Attorney or Public Defender

13.   Require MOUs with constitutional officers and independent agencies to authorize the IG to provide independent oversight.

14.   Add “public administration or business administration” to the list of professions in which the minimum of 10 years of experience can be obtained by IG candidates.

 

Council Member Crescimbeni requested Mr. Durden to begin drafting legislation authorizing a voter referendum on the Spring 2015 ballot to amend the City Charter to make the constitutional officers and independent agencies automatically subject to the IG’s jurisdiction.

The committee engaged in extensive discussion of the bill with Assistant General Counsel John Sawyer, Steve Diebenow representing Hallmark Partners, the developer of Unity Plaza, and Jennifer Jones, the Executive Director of the Unity Plaza about the extent to which the park may be closed to the public for private ticketed events and about the location, size and public accessibility of various park amenities. The committee discussed a possible amendment mandating that a certain number or percentage of events be open to the public free of charge. Ms. Jones explained that the paid events produce the revenue for the not-for-profit organization to maintain the facilities and program the activities, which are planned for nearly every day of the year.

At the conclusion of the agenda Council Member Schellenberg reported that he has heard from several City department heads that employees have been assigned to their departments who do not report to the department director. He requested from the Mayor’s Office a listing of such employees who are assigned to departments but do not report to the department director.

 

Council Member Boyer reported that the Public Works Department may be requesting approval from the Council to expend funds from various capital project contingency funds for emergency repairs on several roadways.

 

Council Member Crescimbeni made reference to a letter that he (and presumably all other Council members) recently received from attorney Steve Pajcic regarding a claim for pension benefits by the adult survivor of a deceased pensioner.
