At the request of the Chairman, Deputy General Counsel Peggy Sidman briefly outlined the process for appealing a proposed reduction of the Property Appraiser’s budget to the Florida Governor and Cabinet. The appeal must be filed within 14 days of the public hearing on the budget, which will take place at the Council meeting of September 23rd. The Council will need to adopt legislation authorizing the appeal and setting forth the grounds on which the appeal is to be made. Also, since the Property Appraiser is also represented by the Office of General Counsel, provision will need to be made to authorize the hiring of outside counsel to represent the Property Appraiser in the appeal as the OGC will be representing the City’s interests.

Bill Summary

 

The committee discussed several motions regarding possible restorations of the budget lapse imposed on the Property Appraiser’s budget that eliminate the need to appeal the budget reduction to the Governor and Cabinet. The committee noted that the time of the state’s approval of the Property Appraiser’s budget by the Florida Department of Revenue is problematic; the DOR approves the budget in early August before the Finance Committee has really begun it scrutiny of the proposed budget and long before it is ready to make a recommendation to the Council.

 

The committee unanimously approved a motion by Council Member Crescimbeni to reduce the Property Appraiser’s budget by $387,896 (representing the amount of salary and benefits allocated to a merit pay pool and the cost of an aerial pictography project) and to authorize the General Counsel’s Office to appeal the budget to the Governor and Cabinet and to hire outside counsel to represent the Property Appraiser in the appeal. Peggy Sidman clarified the grounds for the proposed appeal for the record.

The committee discussed two amendments distributed at the meeting labeled “Finance Amendment” and “Crescimbeni amendment”.  The amendments dealt primarily with the qualifications of the Inspector General and the authority of the IG’s Office over the City’s constitutional officers and independent authorities.

 

AMEND/APPROVE 6-0

 

1)  Appropriates $206,319 from Office of General Counsel retained earnings to fund hiring of 4  IG employees and provides an employee cap of 4 for the IG’s office;

2)  Changes the time period for written IG reports from “periodic” to “annual”, with verbal reports to the full Council every 6 months;

3)  Corrects scrivener’s errors;

4)  Expands the scope of the prior employment restriction to provide that the Inspector General may not have been employed by the City or any other governmental entity subject to the authority of the IG’s office unless such prior employment was with the IG’s Office itself;

5)  Provides that the IG and Council Auditor shall obtain approval from each other prior to offering a position to an employee of the other’s office;

6)  Attaches an estimated budget for the IG’s Office;

7)  Inserts into the listing of the City’s constitutional officers and independent authorities the provision that the list shall include “but not be limited to” the listed agencies;

8)  Includes a severability provision;

9)  Includes provisions in the qualifications for the IG that a master’s degree is preferred and that the IG must either be certified or obtain IG certification within 24 months of employment;

10)  Strikes Subsection S of Sec. 603.303 to delete reference to negotiating and executing memoranda of understanding with other public entities, authorities or Constitutional officers for those entities to be subject to the oversight of the IG and to pay for the IG’s services.

At the conclusion of the agenda Sheriff John Rutherford addressed the committee about his proposed 2% budget lapse and overtime hour reductions and urged the committee to prioritize its proposed cuts and preserve vital public safety functions rather than impose across-the-board reductions on all departments. The Sheriff requested restoration of $4 million of the proposed $5.5 million in reductions and said that he could identify sources to absorb the $1.5 million reduction. He cautioned that if the reductions hold, then the Community Transition Center will have to be closed to absorb the lapse. Council Member Boyer noted that the proposed budget contains 3 different lapses: the normal lapse (based on each department’s historical position vacancy rate), a non-departmental lapse imposed on the General Fund budget as a whole (excluding the Fire and Rescue Department and Sheriff’s Office) and the Finance Committee’s extraordinary lapse of 2.04%.

Fourth Judicial Circuit Chief Medical Examiner Dr. Valerie Rau requested that the Finance Committee restore $37,000 in part-time hours proposed for elimination in her budget, explaining that those hours provide for vitally needed services at night and on weekends. In response to a question about why a toxicologist position identified as a high priority by the Medical Examiner and approved by the Council in the current budget has never been filled, Dr. Rau said that the salary is so low that despite repeated advertisements she can attract no qualified candidates to fill the position.
