explained the outlines of the settlement agreement, saying that the City
Council has already approved two major steps of the process by authorizing
re-acquisition of the property and by approving a deficiency judgment
settlement rather than engaging in a protracted legal fight to recover
unsecured assets. This bill authorizes the receipt and deposit of the
unsecured settlement amount, which is much higher than was anticipated. Council
Member Crescimbeni requested a brief written report on the history of the
Shipyards project, the City’s investment, and the legal settlement amounts,
and a report on the City’s environmental liability for the property. In
response to a question from Council Member Lumb, Ms. Laquidara reported that
she has received a legal opinion from the City’s bond counsel saying that the
funds may be used for any lawful purpose under IRS regulations as “investment
proceeds” if the settlement proceeds are intermingled with the City’s General
Fund revenues and are expended within 6 months. If not intermingled in the
General Fund or if expended beyond 6 months from the time of deposit, then
they funds may only be used for capital purposes, not operations. She is
seeking a refined opinion on what it means to “expend” the funds
(appropriate? Contract for expenditure? Write a check?). Council Member
Anderson suggested that $2 million of the settlement amount be appropriated
to the Southbank Riverwalk construction project to

Chairman Anderson asked Peggy Sidman to provide information to the committee on the process by which Cindy Laquidara will be replaced as General Counsel. Ms. Sidman explained that different processes apply depending on whether the remainder of the mayoral term is more or less than 1 year. If the term is 1 year or less, then the Mayor may make a temporary appointment which must be confirmed by the Council. If the remaining term is more than 1 year then the Charter provisions regarding appointment of a General Counsel nominating committee come into effect and a full-fledged appointment process is followed.
At the conclusion of the agenda, Public Works Director Jim Robinson made a presentation on the City’s Project Asset Management Optimization (PAMO – formerly known as the “lazy asset” study). The project is being led by Bob Stolp of the Public Works Department and Ernie Franklin, the City’s Public-Private Partnership Officer. Mr. Robinson explained how the scope of the project has changed from the time it was originally envisioned as the amount of already-available information has become apparent. Some of the initial assumptions have proven to be incorrect and the project is now aimed at organizing and systematizing the information already available in multiple City departments, offices and filing locations. It appears that there are relatively few underutilized, high-value assets that could be liquidated to generate substantial amounts of cash (except for a few select downtown properties), and the City does engage in on-going efforts to identify and dispose of unneeded assets. Council Member Boyer suggested that thought be given to allowing more rental of park and community center facilities, including to for-profit entities, for the purpose of generating additional revenues for the City to help fund the maintenance needs of these facilities.
Chairman Anderson stated that the mid-year budget report will be released shortly. He has reviewed a preliminary copy and noted that revenues are running below projections through the first 6 months of the fiscal year, but expenditures have been reduced as well, largely due to spending reductions in the Sheriff’s budget.
