Summary Assistant General Counsel Steve Durden gave a brief summary of a legal opinion he had
issued that day regarding the Mayor’s authority to alter, amend or reduce the
scope of projects approved by City Council. His finding is that, within the
bounds of “reasonableness”, the Mayor as the chief executive officer of the city, does have the power to unilaterally alter or amend
project scopes to meet changing conditions and unexpected circumstances,
within the limits of the budgetary authority granted by the City Council. Public Works Director Jim Robinson
and Charlie Rocheleau representing the Haskell
Company answered numerous questions about the design, bidding and
construction of the project. Several committee members expressed concern with
the communication, or lack thereof, about the changing project parameters

At the conclusion of the meeting
Council Member Crescimbeni questioned the legal sufficiency of the meeting
notices for the “shade” meetings on collective bargaining scheduled for later
that day and the following day, explaining that the notices did not identify
which collective bargaining contracts would be discussed. Assistant General
Counsel Jason Gabriel offered to discuss the matter with City Ethics Officer
Carla Miller to determine what the Government in the Sunshine Law requires with
regard to noticing such shade meetings.
In response to a question posed earlier
in the meeting regarding the Mayor’s position on the proposed fee increases in
the Medical Examiner’s Office (see bills 2014-201 to -205), Margo Klosterman of the Mayor’s Office stated that the Mayor was
not in favor of the fee increases, and only filed the bill at the request of
the Medical Examiner as the means for that office to get the matter on the
agenda for City Council’s consideration. Council Member Schellenberg asked the
Council Auditor’s Office to note in the FY2014-15 budget adoption process
whether the Mayor’s proposed budget for next year includes revenue from the fee
increases as proposed.
