Bill Summary

 

Kelley Boree expressed her concerns about the right-of-way visibility at this location with the type of tree (Crepe Myrtles) being planted. She has requested Public Works to consider changing the type of tree because of growth potential and upkeep cost as it relates to the neighboring park and wants to minimize activity which may cause safety concerns.  Ms. Boree requested modification of bill to ensure that Public Works would be responsible for upkeep of trees and maintain them at a 6 ft height for visibility.

 

Dave McDaniel stated that the trees being purchased were 10 ft in height. The area where the trees are being planted is covered by contracts with the development of new divisions that call for tree trimming across the entire park; any issues would be resolved in the winter per the contract.  

 

John Moscarillo commented that his belief was the Crepe Myrtles were the best choice because when properly planted they usually require less maintenance and this prevents weakening the tree.  Additionally, he stated trees were drought resistant, fairly pest resistant, and adds color in the fall which is missing in the area.

Kim Scott explained that the second half of the fiscal year is generally the busiest although the current budget ($1,036,000) will not cover the remainder of the year because of big projects such as Operation Urban Blight and additional blight projects (dead tree removals, board ups and demolitions). CM Schellenberg, Anderson and Crescimbeni referenced support of bill and need to figure out how to provide additional resources in order for MCC to continue the necessary work.

Margaret Sidman explained the action taken in Rules Committee meeting.  Rules Committee waived the amount used to purchase the land and allowed the remaining amount to go into the land acquisition trust fund. A question was raised whether CDBG would refund the value of the property or amount put in if it wasn’t used for its intended purpose.  Ms. Sidman received an email from LaCree Carswell stating that according to the Code of Federal Regulations the reimbursement has to be at the fair market value price. Therefore, the Rules amendment would not be in order. CM Lumb questioned the purpose of purchase which was explained to be used for affordable housing.  Joe Namey stated he was contacted by the abutting owner about purchasing property and no notice was sent out about availability of the lot.  CM Lumb had concerns about the policy and how it pertains to informing potential buyers of available property. CM Jones commented that he was in Ms. Sidman referenced policy had been codified in Ordinance Code Section 122.423 and would forward to CM Lumb. Teresa Eichner stated that she would circulate the Mayor’s opinion.

Extensive discussion about the possibility of losing oversight responsibility and capping the amount that JHFA would be able to accommodate applicants.
