Draft Legislation on Definition of Family –

CM Boyer provided
information about a letter CM Love received from Ms. Stacey Duval. She had
concerns that the impact of the proposed legislation on the Springfield area, group
homes, disability, etc. Ms. Duval listed unintended consequences of the
legislation that the committee needed to address before taking action. During a conversation between CM Boyer and
Ms. Duval, it was suggested that the staff needed to conduct further research
on the number typically used for single family definition within the
state. Ms. Duval does not believe that
the number is three. Ms. Grandin
provided copies of the proposed legislation and Gainesville’s Ordinance. She
explained that the proposed legislation would add a new section and chapter to
the Code which would be enforceable through requiring residential leases (one
family per unit); and landlords obtaining permits. There was extensive
discussion about the definition of family not to exclude unconventional
families that are not related by law, blood, adoption or marriage.
CM Love suggested
using a specific number of “unrelated” individuals in the definition. CM Boyer requested
a more thorough review of what number other jurisdictions use in the definition
of single family; and the impact of using unrelated individuals may have, if
any, on the Code.
PUD Revision – CM Boyer
CM Boyer distributed
her draft of the PUD legislation. She commented that conceptually the committee
sees two types of PUD: 1) primarily used for large scale a development which is
preliminary and does not have specifics of site plan but essential for
financing and engineering (PUD Conceptual); and 2) developments that must provide
specifics of the site plan. Thus, depending on the site committee has to waive
various items to approve (PUD Final). The revision will accommodate both types
and allows the committee to add conditions at the conceptual stage. The
committee was asked to review the draft and provide comments or suggestions. CM
Boyer plans to file the legislation in July.
There being no
