Announcement

Mr. Gabriel provided a brief summary of litigation involving the Shiv Investments Properties. Council passed 2013-0067-A in March 2013 which overturned the appeal of the Planning Commission’s approval of 2012-0070-E (package liquor store at property). The courts ordered City Council to amend resolution to include detail findings of specific facts and a conclusion regarding zoning exception; its compatibility or lack thereof to the comp plan and how the law was applied to reach decision.  The information was resubmitted to the courts and the City Council’s decision was upheld.  CM Boyer provided gratitude to the committee and OGC for work involved in this matter.
