Bill Summary

 

Councilman Schellenberg explained the rationale for the bill. Committee members posed numerous questions to Chief Deputy General Counsel Derrel Chatmon about the Randy Wyse and Frank Denton lawsuits against the City and the current status of the 30-year agreement between the City and the Police and Fire Pension Fund board of trustees. George Gabel, the Holland and Knight attorney who represented Frank Denton, Editor of the Florida Times-Union, in the lawsuit alleging City violations of the Government in the Sunshine law resulting from negotiations with the Police and Fire Pension Fund board over changes to the pension plan, described the rulings by the trial judge and appellate court in that case and his perception of the potential impact on negotiating pension changes. Council Member Crescimbeni requested a legal opinion on how the City Charter could be amended to provide a specific set of circumstances in which the collective will of the City Council would take precedence over the desires of the Mayor in giving ultimate directions to the General Counsel as to how to handle legal cases. Assistant General Counsel Steve Durden cautioned the committee that Mr. Gabel is the attorney for a litigant against the City and that interpretation of case law and legal advice should properly be obtained from the OGC, not from a public speaker.
