Summary Assistant General Counsel briefly
recounted his research on separation of powers issues which generally finds
that City Council can delegate to the IG the Council’s investigatory powers
as it relates to legislative issues but not to other issues. Deputy General
Counsel Peggy Sidman said that the enforcement provision as suggested by the
Ethics Officer needs to be redrafted to avoid having the City take
enforcement action against itself, which would be contrary to the Ordinance
Code and City Charter. AMEND/APPROVE

At the conclusion of
the agenda Council Member Schellenberg stated that the Council reduced the Fire
and Rescue Department’s budget by $180,000 representing the salary and benefits
for one position the Council wanted removed. One week into the new fiscal year
that employee is still in office. He will address this situation further at the
Finance Committee meeting tomorrow.
