Bill Summary

 

Karl Sanders and Steve Diebenow representing the billboard industry spoke in favor of the proposed substitute recommended by the Planning Commission. Mr. Sanders noted that the Planning Commission had held 5 hearings on the proposal and the commission’s recommendations are generally agreeable to the parties. He said that this legislation does not affect the outcome of any pending litigation on billboard issues.

 

Tracey Arpen and Bill Brinton representing Scenic Jacksonville in opposition to the bill said that the Planning Commission did not make any recommendations regarding the City Charter amendment on billboards and cautioned that this bill represents the beginning of a slippery slope if the Council takes it upon itself to begin reversing Charter provisions adopted by voter referendum by means of Council-initiated ordinances. Mr. Brinton disagreed with the contention that this bill has no impact on pending litigation, stating that it is relevant and that is why the proposed bill was drafted by its proponents He stated that judicial hearings on two pending billboard-related lawsuits will be held in the next few weeks that may begin to provide some clarity on how the issues will proceed.

Committee members posed questions to Mr. Brinton, Mr. Diebenow, Mr. Arpen and to Rita Mairs of the Office of General Counsel, who is the lead attorney handling billboard litigation. The proponents and opponents of the bill offered contradictory opinions about what will happen when the current billboard settlement agreements expire, including one at the end of 2014.

 

The committee took public comment on the bill, with two speakers voicing opposition to the proposed legislation.

Council Member Brown explained the history of the bill and the participation by numerous interested parties in crafting the final proposal. Assistant General Counsel Cherry Shaw explained that some regulations applied city-wide and other specific regulations apply in the downtown area and in City parks.
