Paul
Harden representing the Jacksonville Jaguars explained the proposed amended
12th Amendment to the team’s lease with the City for EverBank
Field. Upon learning of a pending NFL requirement for the 2015 season that all
NFL stadiums install expanded WiFi capability, the
Jaguars solicited bids to include the WiFi upgrades
in the current stadium improvement project. The proposed amendment to the 12th
Amendment would provide for a cost-sharing arrangement between the City and the
Jaguars to each provide approximately $2 million for the project, with the
City’s share being funded by savings from the current $63 million stadium
improvement project being under budget and from another source to be
identified, possibly as a CIP project in the FY14-15 budget.

Mr. Gabriel responded to several
questions from council members regarding his perception of the proper role of
the General Counsel in relation to the office’s various clients and with
regard to the role of the General Counsel vis-ŕ-vis mayoral staff meetings
and the mayor’s policy setting process. Mr. Gabriel said that the proper role
of the General Counsel is to explain the law and to describe the various
legal pathways by which desired goals may be achieved, and then to let the policy
makers make their decision. He verified that his appointment is to the
position of Acting General Counsel for a period of one year only and said
that, despite a current binding legal opinion stating that he could be
reappointed at that point without going through the full selection process
outlined in the City Charter, he would recommend that the full process be
followed as prescribed. Council Member Boyer noted that the Consolidation
Review Task Force has made several recommendations for reforming the General
