State Attorney Angela Corey addressed the committee about the bill, saying that the City Council has been misled about what the civil citation process is and does. She believes the state statute was inartfully drafted and needs to be amended for clarity. She said the civil citation process one among many diversionary processes available and regularly used and should not be singled out for preferential treatment over any other method. The State Attorney’s Office has drafted an alternative proposal for consideration.

 

Council Member Boyer proposed an amendment to delete references to a Memorandum of Understanding and to statistics about use of the civil citation process cited in the Whereas clauses.

 

A motion by Council Member Carter to defer action on the bill failed 3-3.

General Counsel Cindy Laquidara explained the settlement and reported that she has received a legal opinion from the City’s bond counsel saying that the funds may be used for any lawful purpose under IRS regulations as “investment proceeds” if the settlement proceeds are intermingled with the City’s General Fund revenues and are expended within 6 months. If not intermingled in the General Fund or if expended beyond 6 months from the time of deposit, then they funds may only be used for capital purposes, not operations.

At the conclusion of the agenda, Public Works Director Jim Robinson made a presentation on the City’s Project Asset Management Optimization (PAMO – formerly known as the “lazy asset” study). The project is being led by Bob Stolp of the Public Works Department and Ernie Franklin, the City’s Public-Private Partnership Officer. Mr. Robinson explained how the scope of the project has changed from the time it was originally envisioned as the amount of already-available information has become apparent. Some of the initial assumptions have proven to be incorrect and the project is now aimed at organizing and systematizing the information already available in multiple City departments, offices and filing locations. It appears that there are relatively few underutilized, high-value assets that could be liquidated to generate substantial amounts of cash (except for a few select downtown properties), and the City does engage in on-going efforts to identify and dispose of unneeded assets. Council Member Boyer suggested that thought be given to allowing more rental of park and community center facilities, including to for-profit entities, for the purpose of generating additional revenues for the City to help fund the maintenance needs of these facilities.
