Bill Summary  

 

Though the item was being deferred, the Chairman wanted to open it up for discussion.  He reported that a noticed meeting had been held to address a number of questions and concerns in the proposed legislation.  Mr. Brown informed the panel that it was his understanding that if you are an elected office holder, you cannot own a private business; the owner of the disposal business (Coastal Recycling) for whom this ordinance was designed to assist, is the Mayor of Atlantic Beach.

 

Both Chris Hagan, representing Advanced Disposal, and Jeff Foster, Chief, Solid Waste Division, Public Works Department, explained the various aspects of the recycling business and host fees.

 

Council Member Greg Anderson said that there was a large number of questions about the proposed legislation that remain unanswered and agreed with the Chair in his decision to defer the matter.

Bill Summary

 

Council Member Lori Boyer indicated that she had been conferring with Assistant General Counsel Cherry Shaw.  There were a number of issues that need to be clarified by the Office of General Counsel; of particular concern was some of the language in the proposed ordinance code amendment.  Until those issues are addressed and resolved, Ms. Boyer suggested that the item be deferred.  She indicated that she would be calling a noticed meeting together for Monday, October 13th, to address those issues.  She had specific questions for the Municipal Code Compliance office.  Ms. Boyer expressed concern with homebuilders and realtors being fined for signs.  To those who felt that a clear definition of what constituted a snipe sign, Ms. Boyer quoted from the Municipal Code: if a sign was in the public right of way, it was a snipe sign. 

 

Council Member Kimberly Daniels voiced concern about the political campaign signs that violate the law.

 

Nancy Garcia, Executive Director, Northeast Florida Realtors Association, explained that her members were often unaware of or confused about provisions of the law pertaining to signs.
