Philip Peterson explained the amendment.

 

Jeff Foster, Chief, Solid Waste Division, Public Works Department, provided background on how the legislation came to be crafted and the particular issues and concerns that the sponsor, Council Member John Crescimbeni, wanted to address.  Mr. Foster proceeded to field numerous questions.

 

Council Member Matt Schellenberg indicated that he was unhappy with the proposed legislation and was inclined to vote against the measure.

 

Jeff Foster cited the potential loss of revenue for the City if the proposed legislation was not in place; the applicant (Coastal Recycling) could ship its disposable construction and debris waste materials out of county resulting in a loss of host fees. 

 

Assistant General Counsel Paige Johnston brought to the panel’s attention Ordinance 2013-414-E to explain the intent of the pending ordinance regarding the issue of host and administrative fees.

 

Council Member Lori Boyer indicated that she was not supportive of the proposed ordinance and was concerned that the proposed ordinance’s sponsor was not present to furnish information.

 

Council Member Robin Lumb said that he did not understand the rationale for the rules in the recycling component and was unlikely to vote to recommend approval of the measure.

 

After voting to defer the item, Council Member Bill Gulliford joined the meeting and discussion; he contended that absent the proposed measure, the applicant would be going out of business.  He fielded numerous question as he sought to explain the need for the legislation.

 

The Chair, Council Member Reggie Brown, suggested that a noticed meeting was need with Solid Waste Chief Jeff Foster, to further discuss the proposed ordinance and answer the numerous questions and concerns that had been raised.  He requested that the Research Division ascertain how other jurisdictions address host fee issues.

Assistant General Counsel Sandra Stockwell explained what the proposed legislation entailed.

She indicated that the applicant had met all of the necessary requirements in requesting the vacation of the property.  Council Member Greg Anderson indicated that after conferring with Ms. Stockwell prior to the meeting, a number of the questions and concerns that he had previously raised were addressed and resolved and that he was now supportive of the measure.
