There was a lengthy discussion on this item.

 

Kyle Billy explained that the Ball Building was purchased with tax exempt bonds with the stipulation that the City could not utilize more than 10% of the bond proceeds or square footage of the building for private uses (the building has private tenants on the ground floor level).  John Jones, Real Estate/Public Works was asked if this matter had been broached with the City’s outside bond counsel; if the City exceeded the 10%, it would impact the City’s IRS tax status.  Mr. Jones indicated that he expected to communicate with the bond counsel and apprise the Council Members of his findings prior to Tuesday’s Council meeting.

Until the 10% issue is resolved, Council Member Stephen Joost recommends that the item be deferred.

 

Council Member John Crescimbeni suggested that the item be deferred until there are some answers to issues concerning the price that Teach for America is paying for square footage.  Mr. Crescimbeni is inclined to have the City charge more than what the current agreement stipulates.  He wants to know why Teach for America was not charged anything for square footage when the organization first leased space in 2008.

 

The Chairman deferred the measure.

Kyle Billy, Council Auditor’s Office, feels that an amendment is needed to attach the inflation schedule and to make the five-year extension start at the end of the current agreement.

 

Council Member John Crescimbeni thinks that the item should be deferred because there is no one from the Administration (Planning & Development Department) on hand to field the numerous questions that have been raised.  Council Member Stephen Joost concurs.  There are too many questions that need to be answered.

John Jones, Public Works/Real Estate, explained what the proposed legislation entailed.

 

Council Member Reggie Brown raised the issue of storm water and drainage.  He wants the Administration to provide a presentation on the status of whose purview is sewage and drainage, particularly since the dismantling of the former Water and Sewer Expansion Authority.  The Council Member wanted to know what are the projects that are underway or planned that are financed by the storm water fees that the City collects from residents.

 

Lin White, Public Works Liaison, indicated that Public Works would have John Pappas at the next Committee meeting to address storm water fee-funded projects that are underway or planned.
