At
the beginning of the meeting the Chairman distributed copies of a letter
received by General Counsel Jason Gabriel from attorney Hank Coxe representing Robert Klausner,
the attorney for the Police and Fire Pension Fund, who was subpoenaed by the
Finance Committee to appear at today’s committee meeting to discuss a series of
documents requested by the committee. Mr. Coxe
requested that Mr. Klausner be excused from appearing
before the committee until a meeting in January. Council Auditor Kirk Sherman
distributed and discussed a document compiled by his staff providing the
results of a review of a sample of the documents provided to the committee by
the Police and Fire Pension Fund at the last meeting. The analysis of the
sample showed that the PFPF provided some, but not all, of the requested
documents, and that the missing documents tended to be older (pre-1990)
documents. In response to a question from Council Member Crescimbeni about the
ramifications of the failure of the PFPF to provide all of the documents
requested, Loree French of the General Counsel’s Office said that the Fund is
not required to provide documents that do not exist, and a personal appearance
by a representative of the Fund who is the custodian of the documents would
allow the committee to question why some items were not provided. Chairman
Gulliford said that he would invite a PFPF representative to the next meeting
in January, giving the Council Auditor’s Office additional time to sort through
the documents already provided and determine what requested materials are
missing.
Motion (Crescimbeni): 1)
the Finance Committee encourages the Council Secretary to send one set of the documents
provided by the PFPF in response to the subpoena to Ted Siedle
of Benchmark Financial Services, with whom the Council contracted for a
forensic audit of the PFPF’s administration and investment returns; and 2) the
committee directs the PFPF to send a representative to appear at the first
committee meeting in January (either voluntarily or via issuance of another
subpoena) to discuss the documents delivered at the last meeting – approved 7-0.

plans to fund maintenance and repairs of the Sports Complex facilities if the
tourism tax now allocated for that purpose is used primarily for debt service
on the new facilities. The impact of reduced permanent seating on the
