Prior to the regular agenda Christie Holochek of the Art in Public Places Commission gave a brief presentation on the City’s Art in Public Places program, gave an overview of the collection, and described how the 0.75% allocation of capital building costs is allocated to the purchase and maintenance of public art and the administration of the program. She briefly reviewed the projects covered by pending Ordinance 2015-763.

Bill Summary     

 

Deputy General Counsel Peggy Sidman stated, in relation to a question posed at the committee‘s last meeting, that the General Counsel’s Office cannot guarantee that an aggrieved party won’t attempt to utilize this ordinance or Ordinance 2015-683 as part of a lawsuit regarding eligibility of PFPF employees to be members of the General Employees Pension Plan, although the intent of the ordinances is only to clarify that such eligibility has always existed. CAO Sam Mousa stated that he and Finance Director Mike Weinstein have met twice with the PFPF in an attempt to reach a settlement on the issue of former Executive Director John Keane’s pension and the fund has been given a deadline of Friday, November 20th to agree to a settlement or General Counsel Jason Gabriel is prepared to initiate legal action against the fund. Peggy Sidman was asked to report to the committee on the General Counsel’s timeline for initiating legal proceedings should the PFPF board not respond in an acceptable manner by the Friday deadline.

Chairman Gulliford posed questions about construction and demolition debris recycling facilities and host fees to Public Works Director John Pappas and pointed out that only one company operating in the county is subject to the host fee to which this ordinance applies. Sam Mousa stated that the administration accepts whatever policy decision the Council may make regarding the applicability of this host fee but cautioned that the ultimate fiscal impact may change substantially if the Old Kings Road Landfill were to change its current operating procedures and begin shipping more non-recyclable remainders out of the county.

Chairman Gulliford requested Mr. Mousa to check on the progress of the renovation of two floors of the office portion of the Florida Theater building, which seems to be taking excessively long to complete. He believes there is great potential to use that office space to house not-for-profit social service and arts agencies to add to downtown’s employment base and lively ambiance.

 

Public Comment

Joe Strasser recounted his experience in the Fire Department and City Budget Office in the 1960s and 1970s and recommended “redlining” the fire safety officer positions to be eliminated as they are vacated over time so as not to impact the incumbent officers who took those positions in good faith.

Devin Carter representing the Police and Fire Pension Fund delivered a box of materials to the committee in response to its subpoena for fund documents issued several weeks ago. The committee will review the documentation and will pose any questions that arise to the PFPF at a later date.
