Subpoena -RE: Forensic Investigation of City of Jacksonville Police and Fire Pension Fund Authorized by Ordinance 2015-200-E are on file at Legislative Services Division.

 

 

Fire Chief Kurt Wilson gave a brief presentation about fire inspections at the request of the Chairman in response to a complaint he had received from a constituent. Chief Wilson explained that both the City Fire Marshall’s office and private sector fire equipment inspectors are certified by the state to perform inspections of fire equipment (fire extinguishers, sprinkler systems, etc.) and it appears that some private inspectors are entering businesses dressed in uniforms and badges and implying that they are working for the City or state Fire Marshall, performing inspections, and demanding immediate payment from the business owner to certify any equipment for which the certification might be out of date, under threat of closing down the business on the spot. The Sheriff’s Office has investigated several incidents and determined that, although these inspectors imply that they are something they are not and threaten to take action that they don’t have the power to take, they are not committing a crime that can be successfully prosecuted. The Fire and Rescue Department has plans to increase its efforts to inform business owners about fire inspection regulations and the right of the owner to hire the private inspector of their choice to perform inspections of fire equipment. Chief Wilson said that the JFRD’s inspectors never collect cash on the spot when they perform inspections; the business is sent a bill later for payment.

In response to a question from Council Member Boyer about whether there was any potential for the enactment of this ordinance to be used against the City in litigation over the PFPF’s Senior Staff Voluntary Retirement Plan, attorney Loree French of the General Counsel’s Office indicated that there are no guarantees in the world of litigation, but the City’s position is that this bill merely reiterates the ordinance as it has always existed and makes no change whatsoever to the eligibility of employees of the PFPF to be members of the General Employees Pension Plan, which they have always been eligible to join. The committee discussed adding an additional Whereas clause to even more clearly state that PFPF employees have always been eligible to join the GEPP.

Bill Summary    

 

Chairman Gulliford gave a history of host fee issue and explained that the host fee on construction and demolition recycling residual debris disposed of out-of-county only applied to 2 companies that self-reported their out-of-county disposal as a condition of their solid waste facility operating certificate. It did not apply to other recycling companies that did not have that condition in the certificate which he believes is unfair and needs to be rectified by this bill. He also advocated for a comprehensive solution to the issues surrounding host fees and solid waste flow control. He intends to ask the Council President to resurrect the now-defunct Council Solid Waste Committee after the first of the new year to push for solid waste ordinance reforms. Council Member Boyer asked for clarification from the General Counsel’s Office about whether changes in the solid waste ordinance automatically change conditions attached to solid waste CONs.

In response to a question from Council Member Boyer, Guy Parola representing the Downtown Investment Authority stated that the DIA board had recommended approval of the lease of the additional 50 spaces. Ms. Boyer questioned the wording of the renewal provision in the parking rights agreement and whether all 250 spaces were automatically renewable for 10 years upon mutual consent of the parties. Paul Harden representing the DuPont Fund disagreed with Council Member Boyer’s interpretation of the renewal language and Deputy General Counsel Peggy Sidman was asked for a clarification by the Office of General Counsel as to the intent of the language. Finance Director Mike Weinstein reported that the administration is in the process of commissioning a downtown parking study and prefers that the additional 50 spaces be leased for a term of 5 years only.

Council Member Boyer requested deferral of the bill in order to have a full discussion and, if approved by the Council, to have the time to organize a full-fledged campaign to explain the amendment to the general public before the referendum. She noted that the Task Force on Consolidated Government recommended the 3-term limit as a means of retaining institutional knowledge on the council for a longer time and opposed staggered terms with elections every 2 years. Council Member Schellenberg feels that Jacksonville’s ability to achieve leadership positions in the Florida League of Cities and Florida Association of Counties and advocate for its important issues is hampered by the 2-term limit that most other jurisdictions do not have.
