Chairman
Gulliford reported that the forensic auditor hired by the City Council to
analyze the Police and Fire Pension Fund (PFPF) has reported encountering
difficulty in obtaining needed documents from the PFPF and suggested the need
to invoke the Finance Committee’s right to issue subpoenas to compel the
production of the documents. The committee discussed what the subpoena(s)
should request, whether a list of specific documents or a personal appearance
by the custodian of the documents, or both.
Deputy General Counsel Peggy Sidman urged that the subpoena(s) be very
specifically worded to ensure that the committee expresses exactly what it wants
to be produced and presented and there is no opportunity for haggling over the
express versus implied intent of the wording.
Motion: the Finance
Committee authorizes the issuance of 3 subpoenas for persons to appear at a
future Finance Committee meeting with specific requested documents or information
about documents that no longer exist – one to the Police and Fire Pension Fund;
one to Robert Klausner, attorney for the PFPF, and
one to the Klausner law firm custodian of records for
the PFPF – approved 6-0.
Ms.
Sidman informed the committee that the date of the appearance of the subpoenaed
persons and records before the committee will depend on when the subpoenas are
prepared and served on the named parties, who are allowed at least 7 days by
law to assemble the requested documents.

Summary Council Member Crescimbeni explained
the intention behind the amendment and agreement extension as a means of
helping the City to achieve its state-mandated solid waste recycling goals by
2020. Council Member Boyer asked about the proper venue for pursuing
remediation of a recent increase in complaints about poor performance by all
the waste haulers, both the private contractors and the City forces. Robert
Campbell of the Council Auditor’s Office explained the mechanisms available
in the triennial rate review process, the next edition of which will begin in
early 2016. Attorney Gayle Petrie of the General Counsel’s Office suggested,
in response to a question from Ms. Boyer, that this amendment and extension
ordinance is a better vehicle for addressing service quality issues than the

financial consulting firm, as part of its work with the City’s former Pension
Reform Task Force which analyzed the JEA’s operating efficiency. Mr. Gulliford
suggested that the report shows that the JEA could operate more efficiently (as
demonstrated by comparisons with similar Florida utilities) and as a result
produce more revenue for allocation to the City.
