Council Member Crescimbeni questioned whether the agreement adequately protects the City’s interests in the event that the amount of “chapter funds” revenue falls and the PFPF has less to invest in paying down the unfunded actuarial liability. He also advocated for inclusion of a mechanism for the City to control the PFPF’s administrative expenses. Council Member Schellenberg opposed including the 7-year waiver of the City Council’s right to impose revised pension benefits at the end of a collective bargaining impasse process and advocated for taking the offensive and negotiating a completely new benefits package directly with the police and fire unions now that the so-called “30-year agreement” has been invalidated by the courts. Council Member Boyer opposed an agreement term that exceeds the 3 years mandated by state law and opposes the PFPF being allowed to create the “share plan” immediately.

 

A motion to call the question was approved 5-4.

Bill Summary

 

Chairman Clark explained the rationale for selecting Ernst & Young without a competitive procurement process, given impediments to the selection of other potential accounting firms. Kirk Sherman explained the difference between an annual financial report (primarily an attestation of conformance to generally accepted accounting principles) and a more intensive audit looking at areas of weakness and projecting future financial trends. He stated that the success of the audit would depend in large part on the amount of manpower and resources both the City and E&Y are willing to invest in the effort. Sam Mousa representing Mayor-elect Curry’s transition team explained the mayor-elect’s rationale for the audit. Several committee members objected to performing this type of in-depth audit in the middle of the budget preparation period when the Finance Department and Auditor’s Office have the least time and attention to devote to this effort.
