The committee engaged in considerable discussion of this issue with Public Works Director Jim Robinson, Environmental Quality Division Chief Melissa Long and Bud Para, JEA’s Chief of Public Affairs. Questions were posed and answered about the City’s and JEA’s water quality mandates under the Clean Water Act and Florida DEP regulations. Mr. Robinson explained the difference between JEA’s point source-related mandates and the City’s non-point source mandates. It has been determined that the purchase of water quality credits from another agency is the City’s most practical and economical method of meeting its nutrient reduction requirements by this summer’s deadline. He stated that the City has developed plans (as part of its long-range stormwater master planning process) to reduce nutrients by means of septic tank phase-outs and stormwater improvements, but the costs are very high for the small amounts of credits achievable through those means, making the costs per ton of nutrients removed very expensive. Mr. Para explained the rationale behind the JEA’s corporate position that it is not the responsibility of JEA’s current customers to pay the costs of extending the sewer system to properties served by septic tanks, considering that those sewer customers paid the unsubsidized costs of their sewer connections when their homes were constructed. The committee discussed JEA’s status as a wholly-owned subsidiary of the City and some members questioned why the City should pay JEA for credits when the City and JEA are fundamentally the same entity owned by the City’s taxpayers.

A motion by Council Member Boyer to amend the interlocal service agreement to provide that Atlantic Beach would reimburse Jacksonville annually for the actual cost of contract fire and rescue service rather than using the current formula of an automatic 3% annual increase on a cost originally set a number of years ago failed by a vote of 3-6. A motion to defer the bill was approved by a vote of 5-4.

At the conclusion of the agenda Council Member Schellenberg asked Jeff Zeichner, Audit Manager for McGladrey, the City’s external auditor, to address the committee on the progress of the City’s independent audit which was due to be completed by March 31st as required by the City Charter. Mr. Zeichner explained the role of the independent auditor in reviewing and opining on the compliance of financial reports prepared by the Finance Department with applicable governmental accounting standards and state and federal requirements. He noted that several required elements of the financial reports have not yet been received, including financial data from the JTA, information on environmental liability concerns, and City pension actuarial data that needed to be refined in response to a new GASB rule that was just announced in December 2014 after the end of the fiscal year being audited. Council Auditor Kirk Sherman explained that the Auditor’s Office is contributing additional manpower to the pension task to help keep the cost of the audit down. The committee questioned Chief Financial Officer Ronnie Belton about the delays in completing the financial reports. Mr. Belton emphasized that the true deadline for completion of the financial reports and independent audit is the June 30th deadline for submitting the documents to the state Division of Financial Services, notwithstanding the City Charter’s March 31st deadline. He emphasized the importance of getting the financial reports right versus meeting a self-imposed deadline. Mr. Sherman noted that the Finance Department has had a long-standing problem with keeping its most talented employees, who are frequently hired away by other departments and independent agencies at higher salaries. Council Member Crescimbeni requested from Mr. Zeichner a detailed list of the outstanding items that are preventing completion of the audit. Council Member Daniels cautioned that the recent media attention to the delayed completion of the financial reports may be politically motivated given the on-going mayoral contest.
