Council Member Boyer questioned the proposed amounts for several listed projects and asked whether Waterways Commission and/or City Council specific funding caps on projects are being accurately captured in project descriptions and exhibits. She also questioned why projects abandoned by the Council have reappeared on the FIND list. Tera Meeks, Chief of Waterfront Management, answered questions and described the department’s rationale in revising the scope of several projects. Several amendments were offered to adjust the proposed project list.

Council Member Schellenberg expressed opposition on the grounds that it would likely lead the administration to reduce the library’s budget by the amount of the projected fine revenue, thereby producing no gain for the library. Council Member Gulliford advocated for allocating the fine revenues specifically to capital improvements and repairs. Mark Merritt, Deputy Director of the library, said that was the library system’s intent in using the funds. Council Member Crescimbeni asked Mayor’s Chief of Staff Chris Hand for an administrative policy decision on how they would treat this fine revenue in next year’s budget planning process, should the bill be enacted.

The committee engaged in extensive discussion with Mayor’s Chief of Staff Chris Hand, City Treasurer Joey Greive, and actuary Robert Dezube of Milliman Associates about the expedited pay-down of the unfunded pension liability and the value of City Council having an opportunity to re-open the issue of unilateral changes to pension benefits should the financial scenarios being anticipated not play out as expected. The committee discussed the merits of a 3-year versus 6-year versus 10-year waiver of the Council’s right to unilaterally impose pension benefit changes. Mr. Hand noted that the Council retains the right to unilaterally impose at the end of an impasse process in every other area (salary, vacations, step raises, etc.). The committee also discussed the relative merits of approving a perhaps less than ideal agreement as a means of achieving some progress toward solving the pension funding problem versus abandoning this agreement and pursuing legal action to have the so-called “30-year agreement” declared invalid and reopening negotiations with the police and fire unions from a new legal position.

Boyer amendment 1 – sets an ultimate sunset date of April 30, 2016 for the City Council to enact a permanent funding source to implement this agreement.

Boyer amendment 2 – replaces DROP plan “actual net rate of return” with “actual market rate of return” and defines that term and its calculation.

Boyer/Crescimbeni amendment 3 – provides a mechanism for the City Council to regain the power to unilaterally impose changes to pension benefits before the expiration of the 10-year moratorium on such unilateral changes in the event that the City’s annual required contributions (ARC) to the PFPF increase by more than 10% over the projected figures presented in the actuary’s calculations in any one year or cumulatively based on a rolling average; the projected figure tables shall include two charts, one showing the ARC based on the additional contribution of $40 million annually above the actuarially required ARC and the other based on the additional contribution of the net present value of $400 million over ten years (approximately $300 million) up-front.

Public Works Director Jim Robinson explained the impending July 31, 2015 compliance deadline and the need for JEA to modify its DEP discharge permit to reflect this transaction, a process that will take some time. Mr. Robinson answered questions from the committee about the department’s ultimate plans to achieve permit compliance through City nutrient reductions rather than purchase of credits from other agencies. Bud Para of the JEA described how the utility has met and exceeded its discharge targets and generated excess mitigation credits. Council Member Crescimbeni questioned why the City would be paying the JEA for mitigation credits when no other municipal utility in Florida pays its utility for such credit transfers. John Flowe of the Environmental Quality Division answered questions about the enforcement of the City’s fertilizer ordinance.

Assistant Council Auditor Kyle Billy suggested the need to amend a date in the Finance Committee’s previous amendment from 2016 to 2017 and to change the date of the proposed referendum. Council Members Gulliford and Crescimbeni advocated for a method to ensure that all of the General Fund dollars supplanted by the revenue from the new sales tax for fire and rescue services be dedicated to pension liability pay-down. Assistant General Counsel Steve Durden noted that state law requires a dollar-for-dollar reduction in ad valorem millage revenue to offset the new revenue generated by the sales tax, and did not know if the required reduction and a simultaneous millage increase could take place in the same tax year. This is a new local option sales tax with no history or case precedent and therefore little guidance as to how it will actually work. If the City wants an advisory opinion from the Florida Attorney General as to what is actually possible, that needs to be done in the form of a referendum by the City Council posing the questions. Council Member Brown questioned which upcoming election would likely produce the largest voter turnout to gauge public sentiment on this issue.
