CM Carter provided a background on the logistics of the rezoning as it impacts the number of lanes and lot sizes.   After some discussion, staff explained conditions cannot be added without a PUD to guarantee the provisions CM Carter expected. The City has planned to widen road (Old Middleburg Road) but has not acquired the right-of-way.

 

CM Wilson deferred legislation at the request of the CM Carter.

Public hearing opened. Felicia Witherup (owner) provided a summary of the services being offered by Hampton Luxury Villas. Larry Sage (support) distributed a feasible study report to the committee; Joe Fredrickson (oppose) has concerns with the commercial trash bins and decrease in value of neighboring properties. Brandon Nelson (oppose) is concerned how facility can claim offering additional services and attention without increasing employees. He is concerned that applicant has tried to change the residential rezoning twice. Public hearing closed.

 

The committee asked various questions regarding services offered, clientele, and parking. The applicant applied for a land use amendment in 2013 for an assisted living facility but it was withdrawn. The current application is for community residential uses. The major distinction between the two is up to six is allowable in single family residential; and 7-14 people require multi-family (which is not allowable in current zoning and is not comparable to the Comp Plan).
