(provided a brief summary of the purpose of the appeal) CM Holt
explained the process for the appeals hearing: Opening remarks
- Ms. Jane West and Ms. Onita Carr (15 minutes) Public hearing –

remarks - Mr. Steve Diebenow (20 minutes) Rebuttal – Ms.
West (5 minutes) Ms. Grandin
explained that the de novo review means the information received from the Planning
Commission and new testimony heard through the hearing can be used in
combination to make a final determination of action. Ms. West
presented stated the application for the minor modification should be denied
because it violates the criteria regarding square footage and the 2006
Ordinance which limits a 35 foot height requirement in written description of
the PUD. Ms. Carr provided information regarding economic impact of the minor
modification on James Island based on economic obsolesce (anything that
borders the property that could detract from its value). Thus, the City would
lose revenue in property taxes. There was
extensive discussion between committee and staff regarding square footage and
the legitimacy of the application for minor modification. In response to
several inquiries from the Council members, Ms. Grandin confirmed that approval
of the appeal would allow the applicant to resubmit the application for a PUD
rezoning. Public hearing
opened. Five speaker cards in opposition: Chris Sturgeon, Matt Romano, Kena
Miller, Paul Steinbrecher, and Greg Stuart. CM Holt recognized the numerous
citizens in the audience in opposition but did not want to speak. There were
seventeen speaker cards submitted. Mr. Steve
Diebenow requested the committee’s support of the minor modification. He
stated the applicant has met all requirements and received the approval of
the Planning and Development staff and Planning Commission. Mr. Diebenow
commented that the appeal was not submitted timely or on the correct form.
Additionally, he commented that the burden of proof presented to the
committee does not meet the level of the State law. Mr. Courtland
Eyrick conducted an appraisal to determine if minor modification of 11 feet
would cause damage to the adjacent properties. Reviews were done on three
similar properties (All State Building, Glen Kernan Park, & Jax Offices
Building) with small office buildings adjacent to residential properties. Mr.
Eyrick concluded that the market does not recognize any potential damage or a
reduction in property value exists. In response to
CM Joost question, the committee has the option to affirm, reverse of modify
the decision. Any conditions from the committee would have to be imposed by
the Planning Commission; otherwise, the applicant could reapply for a PUD
which would allow to add conditions. Motion/2nd
