Council Member Matt Schellenberg announced that there will be a noticed meeting at noon on Tuesday, December 1st to discuss this proposed ordinance amendment.

 

Assistant Council Auditor explained the clarifications that were in the substitute.

 

Council Member Garrett Dennis, Chair of the NICE Special Committee, advised the panel that this measure is no longer in NICE.  That committee felt that the proposed legislation is not ready for action; more work is required.  He felt that RCDPHS should deny the measure.

 

Council Member Brown lamented that departments did not have the manpower with which to doe their jobs and carry out mandate, required tasks.

 

Council Member Reggie Brown felt that residents are not being properly served by further postponing taking  action on the proposed legislation; neighborhoods needed cleaning-up.  Mr. Brown suggested that the Office of General Counsel, NICE, and the administration should convene meetings to craft the right legislation.

 

Council Member Schellenberg said that NICE wants a better ordinance than the proposed substitute.  He was against sending this ordinance back to NICE.  He would vote against a motion to send the ordinance back to NICE.

 

Council Member Al Ferraro indicated that he would be voting against the bill or substitute.  He felt that the issue at hand was the lack of any ability to enforce provisions.

 

Council Member Dennis said that manpower was a key factor in the inability to enforce the provisions of the proposed legislation; the manpower of agencies should be considered when the Council considers the next budget for the City.

 

The Chair announced that he was deferring the measure.

Council Member Al Ferraro indicated that he had problems in awarding these funds to arts in public places while his Council District had numerous problems in need of funding such as drainage issues.  Assistant Council Auditor Kyle Billy explained that the Ordinance Code mandated that the funds  be  provided for Arts in Public Places.
