3-4 (FAILED) (Bishop, Crescimbeni, Jones, Lee) There was a lengthy discussion on this agenda item. At the agenda meeting, Assistant Council Auditor Kyle
Billy had advised those in attendance that this item had failed in the
Finance Committee that had met earlier in the day. Council Member John Crescimbeni explained what his
concerns were with the Agreement and why he was likely to vote “no” on the
measure. Bud Para, Chief, Public Affairs, JEA,
explained what the Agreement entails and addressed concerns raised by Council
Member Blll Bishop. The amount
appropriated in the ordinance represented the capital expense that JEA will
incur in reducing nitrogen in the river.
Jim Robinson, Director, Public Works Department, explained
what the Basin Management Action Plan requirements for the reduction of
nitrogen in the river were and that credit trading was a component of compliance. He further explained that because of the
considerable costs, the City felt that it was more feasible to rely on the
transfer of water quality credits rather than to invest in building
facilities. Council Member Bishop indicated that he was likely to
oppose the ordinance. Council Member Greg Anderson cited his concerns with the
Agreement but indicated that he was likely to vote for what he characterized
as the “best bad choice.” At. Council Member E. Denise Lee’s request, Assistant
General Counsel Jody Brooks provided the historical background to the
legislation, going back to the Clean Water Act of the 1970s when the
Environmental Protection Agency identified the St. Johns River as
environmentally impaired.; she explained the requirements of the TMDL (Total
Maximum Daily Load) that necessitates the reduction of nitrogen in the
river. Director Robinson explained
that the City could incur considerable financial fines as penalties if it did
not meet its requirements for the reduction of nitrogen in the river. |
