Bill Summary

 

Council Member Crescimbeni explained that the City’s former General Counsel had opined that the SSVRP was not validly created, but only the Mayor can initiate legal action. The Council requested that legal action be initiated but the previous mayor declined to do so. He advocated for taking action to ensure that the question is settled once and for all. CFO Mike Weinstein agreed that OGC binding legal opinions are only truly enforceable by means of legal action if the party to whom the opinion applies refuses to accept its validity. In response to a question from Council Member Hazouri about whether the three participants in the SSVRP would continue to receive their retirement benefits should a court determine that the fund was illegally established, General Counsel Jason Gabriel stated that it would depend on the judge’s ruling.
